HomeMy WebLinkAboutRes2004-069 I I I Sponsored by: Shealy CITY OF SEWARD, ALASKA RESOLUTION 2004-69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A ROCKREMOV AL AGREEMENT WITH WILDER FOR USE OF THE CITY OF SEWARD'S FOURTH OF JULY CREEK ROCK QUARRY WHEREAS, on September 22, 2003, the City of Seward approved resolution 2003-99 setting the price of rock extracted from the Fourth ofJuly Creek Quarry at $5.00 per ton specifically for the East Harbor Expansion Project; and WHEREAS, Wilder has entered into a contract with the US Army Corp of Engineers, and has agreed to provide up to a maximum of 200,000 tons of rock, new and reused from the existing break water for the Seward East Harbor Expansion Project; and WHEREAS, Wilder has determined that a sufficient quantity of new rock of the quality needed for the project is available at the City's Quarry located on tract "c" of the Fourth of July Creek Tracts according to plat 84-6, commonly referred to as the Seward Marine Industrial Center ("SMIC"), whose location is within section 17, TIS, R1E, Seward Meridian (also known as the Fourth of July Creek Quarry); and WHEREAS, the City of Seward wishes to enter into an agreement whereby Wilder may extract rock from the Quarry for use on the Project without interfering with other potential users of the quarry; and WHEREAS, the City agrees that Wilder may excavate, classify and or remove up to 200,000 tons of rock from the Quarry, to be used by the contractor to fulfill its contractual obligation to provide rock at the rate of$5.00 per ton for the East Harbor Expansion Project; and WHEREAS, Wilder may deduct from the payment due a production credit for classifying and stock piling rock for the city, using materials from the unclassified pile and or from production of additional rock from the quarry up to 100% of the rock used/extracted/produced for the East Harbor Expansion Project; and WHEREAS, production credits equal to rock extraction will clean up the Quarry, save approximately $225,000 in clean up costs, put classified, marketable rock on the ground for City use and provide a more attractive site for future operations/management and bids. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The city manager is hereby authorized to enter into an agreement with Wilder, in substantial form as attached hereto and incorporated by reference, for rock removal from the Fourth of July Creek Quarry. CITY OF SEWARD, ALASKA RESOLUTION 2004-69 Section 2. Notwithstanding the forgoing, the city manager may make such changes or corrections as needed to finalize the agreement without changing the essential terms and conditions as set out in the attached agreement. Section 3. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 14th day of June, 2004.
