The public has not yet had a public hearing to comment on the dispositionofcity-owned public propertyas required by Seward City Code Title 7,Public Property, Section 7.05.125, Public hearing and notice.No public notices were posted or published, no public hearing has yet been held.The public should be allowed to commenton the disposition of public property separately,before this Resolution is brought before P&Z. B.From the KPB Parcel Viewer: The Seward Airport is owned by the Alaska State Aviation Division, at 2310 Airport Road, KPB #14502401. Parcel 1 is owned by the Civil Air Patrol, at 2200 Airport Road, 39 acres, KPB #14502221,T1N R1W SEC 34 & 35 SEWARD MERIDIAN SW THAT PTN OF THE W1/2 OF USS 722 AS PER W/D 24 @ 12. Note the KPB shows Parcel 1 at 39acres, not 38.224. Parcel 4 is part of the19.47-acre parcel owned by Leirer Enterprises, LLC, at 1800 Airport Road. KPB #14502404, T1S R1W SEC 2 & 3 SEWARD MERIDIAN SW THAT PTN OF USS 722 LYING NORTH OF RESURRECTION BAY & BOUNDED BY THE SEWARD AIRPORT LIMITS. Parcel 5 is tidelands owned by the City of Seward, no address, or legal description, 25.395 acres. C.Errataand other comments: 1.The title of this SubstituteResolution IIincludes disjointed fragments of the legal descriptions for Parcel 1, Civil Air Patrol, and Parcel 4, Leirer Enterprises, LLC, but does not mention or include the legal description for Parcel 5, the City of Seward tidelands. Legal descriptions are important; correct legals and add legal description for Parcel 5. What doesthis mean:? 2.First Whereas: The Seward Airporthas submitted a preliminary plat to the City of Seward The Sewdid not submit this preliminary plat. 3.Second Whereas: Verify ownership of Parcel 4. The KPB shows the owner as Leirer Enterprises, LLC. Correct the legal descriptions and add legal description for Parcel 5. What does this mean: ? Parcel 1 and 5 will create new ROW for the north and south approach. 4.Third Whereas:2310 Airport Roadis Parcels 1, 4, and 5 are zoned Industrialbut they are not located at 2310 Airport Road. 5.Fourth Whereas: and creation of the relocated Runway 13- 1 all conditions required by Seward City Code §7.05125, Conditions to plat approval, were met; the property owners and leaseholders within 300 feet of the requested replat were notified of the proposed subdivision, and the property was posted with public notice signage; and. Seward City Code 7.05015 exist and Title 7 does not relate to conditions for plat approval or public notice for plats. Title 7, Chapter 7.05, Disposal of Real Property has not been complied with. The Commission hereby recommends that, in accordance with Seward City Code Section 16.01.015 (B), the City Council approve the submittal of the replat of Sec 2 & 3, T1S, R1W and Sec 34 & 35, T1N, R1W, Seward Meridian SW, That Point Known As The Seward Airport to acquire Parcel 1, owned by Civil Air Patrol, Parcel 4, owned by Leirer Family Limited Partnership, and Parcel 5, owned by the City of Seward, to create a new ROW for Runway 16/34, which will be shifted, lengthened, and raised above the 100- This is the first time SCC Title 16, Subdivisions, Section 16.01.015 (B) has been mentioned. Correct to (b). What happened to references to Title 15, Section 15.01.040 Public Hearings, in the first version, and Title 7, Public Property, Section 7.05.125 Public hearing and notice in this version in Whereas number six? See above comments: correct legals, add Parcel 5 legal description, check Parcel 4 ownership, mean? See previous comments about Title 16 Subdivisions code and requirements for providing utilities. 8. Page 5: September 9. Page 7: Subdivision Review: Size: Note the KPB shows Parcel 1 at 39 acres, not 38.224. Existing Use: Steve Leirer does not own Parcel 4. Parcel 4 is not SCC 7.05.115 Definitions: Tidelandsmeans those lands which are periodically covered by tidal waters between the elevation of mean high water and mean low water or are contained within a recorded Alaska Tideland Survey. Access: same comments as before: how will access be platted to the remainder of the Leirer Enterprises, LLC property and for pedestrian access to city tidelands? Add ROW for airspace on the north and south of the relocated runway 16-34. 10. Page 8: Public notice signs were posted on the property and all other public hearing requirements of Seward City Code §15.01.040 were complied with. Requirements for SCC 15.01.040 only address the ROW acquisition plat. Requirements for disposition of public property according to Title 7 Public Property, 7.05.125 Public Hearing and Notice have not been met. Thank you for your consideration of these comments.
