The city docks of the City of Seward include all docks, floats, slips, wharves, ramps, piers, bulkheads, dolphins and sea walls owned or operated by the City of Seward. Section on passenger fees in current tariff 230 PASSENGER FEES (a) Fee. In addition to other tariff provisions, the terms and conditions of this item apply and charges are assessed to passenger vessels, sport fishing vessels, guide and outfitter vessels, and all other vessels carrying passengers for compensation. A passenger fee of $3.50 per passenger shall be paid for each passenger embarking or disembarking a vessel at a City Dock, as such term is defined in Subsection 100 hereof. The passenger fee is assessed once per passenger per excursion regardless of whether the passenger excursion is one-way or round-trip. As used in this subsection, "compensation" means payment to the vessel owner or operator whether by charter or through fares paid by or on behalf of passengers. What the lawver recommended "If the City wishes to expand the category of passengers to whom the passenger fee applies I suggest replacing the phrase "at a City Dock" with "at any location within the Boat Harbor" and adding a definition of Boat Harbor to Subsection 100 that describes the Boat Harbor as all docks, piers etc. located inside the sea wall. I am not sure if that would create a different exclusion based on current commercial operations of sightseeing/fishing charters. The City is already prohibited from assessing passenger fees to large cruise ship passengers by state law. Regardless, it will take a tariff amendment to require Major Marine to remit fees for passengers boarding at the Harbor 360 Dock IMO." Definition of "Harbor" in city code "Harbor" means all waters, tidal areas, and adjacent upland areas owned by the City and listed and identified in the land use plan as "harbor commercial and industrial," together with any and all facilities of a port or maritime nature either publicly or privately owned that are primarily used by or for the service of vessels, including the port facilities located at SMIC, and all docks, pilings, hoists, parking areas, leased water areas, concessions and/or service facilities located within the area defined herein. Proposed change options 230 PASSENGER FEES (a) Fee. Notes "Protected waters" was a phrase Matt came up with that seemed applicable. The lawyer suggested we create a definition for "boat harbor" to add to the definitions section of the tariff, but I think if we just use "Harbor," then maybe we can just take the definition as written in city code and add it to the list of definitions in the tariff? There isn't actually a definition of "harbor" or "boat harbor" in the definitions section of the tariff, so maybe that would be a good thing to include in any case. I think the third option that says "within the areas protected by Harbor infrastructure" might be the clearest, but let me know what you think or if you have any other ideas. PACAB's Mission & Goals PACAB History and Mission After many hours of research and reading over months of council minutes, I feel I have a better understanding of the history of PACAB. It was originally created out of two committees — A port committee and a commerce committee. Both tasked with advising city council on matters applying to the port. It was determined that their business often overlapped so they were merged into what became known as PACAB. PACAB was originally tasked with matters dealing with commerce and the port, specifically, coal, fisheries, harbor development, etc. The most recent change to the code has expanded the mission of PACAB to include all matters affecting the health and well being of the Seward community. I feel that this broad of a scope is not conducive to establishing and achieving measurables goals and can lead to PACAB being responsible for a wide range of topics in which we may not be well versed. The city currently has two other boards — Historic preservation and Planning and Zoning. These boards have very specific name and deal with a narrow focus, allowing member to join knowing full well the expectations of the seat. PACAB is currently dealing with housing, and energy projects that are not currently on our goals or projects list. I believe that the wide focus of the board could be a deterrent to people wanting to serve, but looking for things that pertain specifically to their interests. I think in our upcoming session with city council it is important to look at this from two perspectives — I would like to ask the Council to narrow the scope of work expected of the board — perhaps it is no longer Ports and commerce and should be instead, sustainability through energy and housing. If city council wants the board to get involved in everything having to do with the betterment of life in Seward, the name of the board should be changed to reflect this broader expectation. Either way, I believe that the scope of work should be better defined to assist city council and the name should reflect what city council expects of this board. Brandii Holmdahl Article 3. Port and Commerce Advisory Board Article 3. Port and Commerce Advisory Board 2.30.310 Established. (a) The port and commerce advisory board is hereby created, consisting of seven residents of the City of Seward or surrounding areas, and who shall be appointed by the council. If there is more than one applicant for the position, the council shall appoint by ballot voting. (b) Applicants must receive at least four votes in order to be appointed. No officer or employee of the city may be appointed a member of the board. (c) A chairman of the board shall be selected annually by the appointed members. (d) The city manager will appoint a city employee to serve as an ex officio member of the board who shall have the privilege of the floor but not the right to vote. (a) Members of the port and commerce advisory board shall be appointed for a term of three years; provided, that the terms of initial appointments shall be staggered so that as nearly as possible a pro rata number of members shall be appointed for each year. (b) The council may appoint any qualified person to fill a vacancy of any member of the board provided that the appointment shall be for the unexpired term of the vacancy. (c) Following a member's absence from three consecutive regular meetings of the board, the remaining board members shall decide whether the board member should be retained or whether to request council appointment of a new member. (d) Members shall not be paid for services on the board or participation in board activities without prior approval of the city council. (Ord. 512, 1982; Ord. 93-23; Ord. 2000-13, § 2, 2000) 2.30.320 Meetings and quorum. (a) The board will meet at a time and place to be designated by the board. (b) Four members of the board shall constitute a quorum for the transaction of business except that, in the absence of a quorum, any number less than a quorum may adjourn the meeting to a later date. The affirmative votes of at least a majority of those board members present shall be required for any action. (c) All meetings and records of the board shall be open to the public. The board shall keep minutes of proceedings showing the vote of each member upon each question and shall keep records of any actions, all of which shall be immediately filed in the office of the city clerk and shall be a public record. (a) It shall be the responsibility of the port and commerce advisory board to: (1) Report annually to the city council at the first council meeting of the new fiscal year and at any other time as may be requested by the city council. The annual report shall include, at the minimum, a report on the prior year's activities, a list of any anticipated requests for appropriations for the year's planned activities and a recommendation regarding the continuation of the board; (2) Make recommendations to the city council concerning the design and coordination of projects to promote and develop transportation, trade, energy and commerce throughout Seward; (3) Provide input to the city council on policy and procedural matters involving the establishment and continuance of commercial activity, improving the quality of life and protecting the public's best interest; (4) Advise the city council on matters involving the establishment of support services towards the objectives outlined in subsections 2.30.325(a)(2) and 2.30.325(a)(3); (5) Perform other duties as requested by the city council. (b) The board shall have no authority to expend or commit city funds without first obtaining approval by and any necessary appropriations from the city council. The city council, at the first meeting of each fiscal year by an affirmative vote, may continue the existence of the board. In the absence of an affirmative vote by the council, the board will cease to exist within 30 days. If appointed at Council's organizational meeting in October, the council's representative to the Kenai Peninsula Economic Development District (KPEDD) is the liaison to this board, attends its meetings, and reports regularly to Council regarding its activities. If a liaison was not appointed, a member of this board will be appointed to give periodic reports to the city council. The Port and Commerce Advisory Board will automatically dissolve if not continued by the affirmative vote of the Council at its first meeting of the fiscal year. Membership on the Port and Commerce Advisory Board is open to citizens of the City of Seward and surrounding areas. The Port and Commerce Advisory Board has the following duties: 1. Reports annually to Council at the first Council meeting of the new fiscal year and at any other time as may be requested by Council; 2. Makes recommendations to Council concerning the design and coordination of projects to promote and develop transportation, trade, energy and commerce throughout Seward; 3. Provides input to Council on policy and procedural matters involving the establishment and continuance of commercial activity, improving the quality of life and protecting the public's best interest; 4. Advises Council on matters involving the establishment of support services towards the objectives outlined in SCC 2.30.325(2) and (3); 5. Performs other duties as requested by Council; and 6. Shall have no authority to expend or commit city funds without first obtaining approval by and any necessary appropriations from Council. 7.
