The sale of public land is a very important action that should be clear and accurate. The intent, parcel, description, maps, quit claim deed, and other important data are inaccurate.The parcel is unzoned. Should it be rezoned to Industrial during this process? IF there are section lines bisecting the property, should they be vacated? I started to edit this Resolution, below for a substitute Resolution, but feel the changes are substantial and deserve more time. I urge Council to postpone this to the next meeting so that these important corrections can be made before our public asset is sold. Suggested changes: Page 135: Change Attachments, Appraisal FMV of"Parcel #14502419" to "Parcel 5". Page 136: Change Agenda Item: Resolution 2022-031: Authorizing the Sale of"Parcel #14502419" to "Parcel 5"... Change ..."in Improving the Seward Airport" to "for ROW acquisition to protect the aircraft approach to the runway. Parcel 5 contains 25.395 acres and is appraised at the Fair Market Value (FMV)of$2000.00." Page 136: Background and justification: Replace first two paragraphs with: "The City of Seward owns Parcel #14502419 of tidelands/submerged lands across the north end of Resurrection Bay that contains approximately 1000 acres.The State of Alaska Department of Transportation (ADOT) is requesting purchase of 25.395 acres, known as Parcel 5 in the Seward Airport Improvement Project Replat, as a ROW acquisition to protect the aircraft approach to the new runway. Parcel 5 is appraised at the Fair Market Value (FMV) of$2000.00." "The property consists of only tidelands/submerged lands that have no improvements. It is located due south of the airport property bounded to the west by the Alaska Railroad Terminal Reserve in Seward,T IN and IS R 1W Section 34 and 3 Seward Meridian SW." (Get correct complete legal description.The one provided is not accurate). Seward Airport Improvement Project Page 138 and 139: Resolution 2022-031 Airport ROW acquisition According to the DOT Right of Way Agent on page 140, this is a ROW acquisition to protect the aircraft approach which extends from the bay to the new runway, but the Resolution does not specify this anywhere (see above corrections.) First paragraph of the Resolution: Parcel 1452419 contains approximately 1000 acres. This Resolution should authorize the sale of 25.395 acres of Parcel #1452419, not the whole parcel. First Whereas: Parcel 5 is part of Parcel 1452419 as per a replat of this larger parcel. According to the KPB Parcel Viewer, Parcel 5 is bounded to the west by the Alaska Railroad Terminal Reserve in Seward,T IN and IS R 1W Section 34 and 3 Seward Meridian SW, not Parcels B and C, US Survey 9000.The DOT map on page 141 differs from the KPB information. Second Whereas: change "Parcel 14502149" to "Parcel 5", is "a rectangular parcel south of and adjacent to the airport property", and correct "consist" to "consists". Third Whereas and Section 3:This ROW acquisition involves tidelands/submerged lands for aircraft approach and departure.The DOT will NOT utilize the property for the purpose of improvements and reconstruction of the existing two runways, place erosion control measures, widening of the taxi way and installing new lighting, markings, and fencing. Delete and correct. Page 144 Quit Claim Deed: According to the KPB Parcel Viewer, Parcel 5 is bounded to the west by the Alaska Railroad Terminal Reserve in Seward,T IN and IS R 1W Section 34 and 3 Seward Meridian SW, not Parcels B and C, US Survey 9000. The DOT map on page 141 differs from the KPB information. The Alaska Tideland Survey 174 does not show up on the KPB Parcel Viewer site or DNR state tidelands survey as it was granted to the city as Parcel 1452419. Page 146 DOT sheet 1 of 3 has many errors, apparently based on an outdated map.The Seward Highway is not Lot 2 or 4 USS 9000. Lot 3 USS 9000 is now Parcel 14502517, Alaska Railroad Terminal Reserve in Seward.There is no Parcel B or C, or Lot 9 USS 9000, USS 149, or ATS 174 where shown.The appraisal company used this same outdated map, page 169 and 170. Page 181 The appraiser used an even older map to show the subject, indicated by a vague, misplaced arrow.This map could predate the 1964 earthquake as the river is far to the east, roads are indicated where none exist now, and new roads are non-existent. Page 184: Easements:The title report indicated section lines bisect the subject. I believe the section lines do not intersect Parcel 5. However, if there are section lines present, they should be vacated as part of the plat as they permit public access. Page 184: Zoning. "The site is unzoned."The adjacent airport property and railroad property are zoned Industrial. Should this—25-acre Parcel 5 be zoned Industrial as part of this process? "Unzoned is classified as "light, heavy or industrial park land uses, and utility transportation land uses." What is the source for this definition? Page 184 and 189: Suitability: Appraiser did not consider Conservation as a suitable use.This is a rich tidelands that sustains wildlife, especially birds and intertidal life. For those that live there, and those who appreciate them, this parcel is priceless. Page 188: Comparison Report is wildly out of date, unless this is a shed sales report.The average days on market is the minimum of 5 and house prices have skyrocketed to over twice assessed value. Page 189-245 Did not preview. Is appraiser paid per page?
