HomeMy WebLinkAboutRes2022-017 Laubner Addition UR to AC Sponsored by: Applicant Public Hearing Date: August 2,2022 CITY OF SEWARD,ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2022-017 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, RECOMMENDING CITY COUNCIL APPROVAL OF THE LAND USE AMENDMENT TO REZONE LOTS 21-23, BLOCK 10, ORIGINAL TOWNSITE OF SEWARD LAUBNER ADDITION, FROM URBAN RESIDENTIAL (UR) ZONING DISTRCIT TO AUTO COMMERCIAL (AC) ZONING DISTRICT WHEREAS, Exit Glacier Guides, Inc. has submitted a Land Use Amendment Rezone application for review and recommendation to the City Council; and WHEREAS, the proposed Land Use Amendment would rezone Lots 21-23, Block 10, Original Townsite of Seward Laubner Addition, from Urban Residential (UR) Zoning District to Auto Commercial (AC) Zoning District; and WHEREAS,the physical location of these two lots are 1104 & 1100 Second Ave; and WHEREAS, the current use of the property as a parking lot is not required by City Code for the operation of the business owned by Exit Glacier Guides Inc. located at 1013 Third Ave; and WHEREAS, the applicant intends to stop the current use of 1104 & 1100 Second Ave as a parking lot regardless of the determination of this public hearing; and WHEREAS, the current zoning for Lots 21-23 is Urban Residential, which is restrictive to primarily residential development and does not allow for more diverse economic development; and WHEREAS, the proposed rezone to Auto Commercial would allow more options for economic development as well as housing development; and WHEREAS, the size of the land being rezoned is approximately one-fifth of an acre; and WHEREAS, Seward City Code 15.01.035(b)(3) allows the rezone of land less than one acre when the land is contiguous to the requested zoning district; and Seward Planning and Zoning Resolution 2022-017 Page 2 WHEREAS, the properties adjacent to the east of the proposed rezone are zoned Auto Commercial and have been designated as such since 1985; and WHEREAS, the public notification process was complied with and the appropriate public hearing as required by Seward City Code § 15.01.040. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The Seward Planning and Zoning Commission supports the proposed zoning change and recommends Resolution 2022-017 be forwarded to City Council for approval. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 2nd day of August, 2022.
