HomeMy WebLinkAboutRES2023-007 R&M Task Order for CRRC Easement CITY OF SEWARD,ALASKA Sponsored by: Bower RESOLUTION 2023-007 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO EXECUTE R&M ENGINEERING TASK ORDER NO. 2734.28, COMPLETING REQUIRED SURVEY WORK AND CREATING UTILITY EASEMENTS WITHIN TRACTS 1A AND 1B, WATERFRONT TRACTS, MARICULTURE ADDITION, IN THE AMOUNT OF $28,184 AND APPROPRIATING FUNDS WHEREAS,City Council passed Resolution 2022-122 on December 12, 2022; and WHEREAS, Resolution 2022-122 authorized the City Manager to enter into and execute the Purchase and Sale Agreement and related documents with Chugach Regional Resource Commission (CRRC) for the sale of 1.52 acres of land and the related improvements, physical address 101 Railway Avenue, Parcel 14920016, in the amount of$500,000; and WHEREAS,the City of Seward is in the process of selling city land that Alutiiq Pride Marine Institute inhabits to the Chugach Regional Resources Commission; and WHEREAS,there is a need to create easements for active water and wastewater lines, as well as access to Lowell Creek; and WHEREAS,the City does not normally have easements for their own land; and WHEREAS, it is vital that the City of Seward has access to public infrastructure on privately owned land; and WHEREAS, Task Order 2734.28 will generate the water, sewer, storm drain, and access easements that the City will need to maintain its infrastructure. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA that: Section 1. The City Manager is authorized to execute R&M Task Order No. 2734.28 with R&M Engineering for the creation of water, sewer, and access easements within Tracts 1 A and 1B, Waterfront Tracts, Mariculture Addition. Section 2. Funding in the amount of$28,184 is hereby appropriated from General Fund reserves account no. 01000-0000-3400 to Contracted Services account no. 01000-1122- 7009. Section 3.This resolution shall take effect immediately upon adoption. When city land is sold, it is important for the city's infrastructure to be protected and for the city to have access for maintenance. As the City is proceeding with the sale of the Alutiiq Pride Marine Institute land, there is a need to create three easements. This requires surveying the property,the placement of each easement, and processing those with the Borough. Creation of the easements was included as a provision in the purchase and sale agreement between CRRC and the City. R&M Consultants, Inc. (R&M) has based this response on the information provided by you via e-mail on 9101 Vanguard Drive December 2nd and during subsequent phone conversations. We have reviewed the materials provided to Anchorage,Alaska 99507 us and have prepared the following cost estimate for your review and comment. phone:907.522.1707 We understand that you would like us to produce exhibits and legal descriptions for four document fax:907.522.3403 easements for utilities that fall within Tracts 1A and 113, Waterfront Tracts, Mariculture Addition, according to Plat No. 97-18. The easements will be based on the surveyed location of each utility and referenced to the tract boundary in which they fall. A boundary survey of the two tracts will be required, and we will field locate all associated utilities. Specifically,the location of the sewer and water lines will be determined based on above ground evidence and any underground locate marks that the city is able to provide. The storm drain outfall will be located as well and serve as the basis for the access easement within Tract 1B. The configuration of the easements will be determined through discussions with the City of Seward and your office. We anticipate creating a map exhibit showing the tract boundaries and the utility locations that can be marked up by you before creating the final documents. Final documents for each easement will include an Exhibit A containing the legal description, and an Exhibit B containing the exhibit. Each document will be stamped by a professional land surveyor and can be included with final easement documents produced by your office. Deliverables: ■ Legal descriptions and exhibits for four easements Schedule: We can begin the project within one week of receiving the Notice-to-Proceed (NTP). We expect to produce the final products within four to six weeks of NTP depending on how quickly we can determine the final configuration of the easements. Cost Estimate: Based on the scope and our understanding of the project, we propose a Time & Materials Fee amount $28,184. We have attached a detailed breakdown of our estimated costs for your review.
