CITY OF SEWARD
RESOLUTION NO. 436
DE IT RESOLVED that the following instruments be and are hereby approved and
the City r~nager and City Clerk are instructed to execute and deliver:
1. Quit-claim Deed from the City of Seward to the United State of America
conveying the area containing the Seward Small Boat Harbor rock breakwater
and boat basin constructed by the United States of An~rica during 1964 and
1965 with detailed description set forth in the instrument;
2. Perpetual Easement frma the City of Se,~ard to the United States of America
to remove any of the land described in said easen~nt and identified as 911a~e ~ jis,
tidelands for the construction and maintenance of the aforesaid work or any
improvments and enlargement thereof and to maintain the portion so vacated
as part of the navigable waters of the United States;
3. Perpetual Easement from the City of Seward to the United States of America
to remove any of the land described in the said easen~nt for the construction
and maintenance of the aforesaid work or any improv~~ents or enlargement thereof
and to maintain the portion so vacated as a part of the navigable ,.aters of
the United States.
BE IT FURTHER RESOLVED that an emergency is hereby declared to exist in that
the construction of the boat harbor must proceed with all due speed and since
the United States of America requires the aforementioned conveyances to be of
record in order to proceed; that it
BE FURTHER P~SOLVED that due to the above stated emergency conditions. the
provisions of Ordinance No. 315 relating to conveying real property owned by
the City of Seward. except as below stated. be and hereby are waived for this
one specific transaction.
This Resolution shall be posted and published in accordance with Ordinance No.
315. pa~~ and approved by the
