Background Histoxy The original plat, Dairy Hill Subdivision, 2000-21, recorded 12-22-2000 The Dairy Hill Subdivision, Tract 1-5, created in December 2000, contains about 18 acres, is bisected by Scheffler Creek about its center, has Spring Creek on its East boundary near the Seward Highway, contains wetlands and flowing water on its South boundary at Dairy Hill Lane, its West boundary, west of Scheffler Creek, is dry, mixed land with grades and level ground. Dairy Hill. Subdivision Re-Plat in 2018, plat No 2018-13, recorded 12-11-2018 The Dairy Hill Subdivision in 2018, was replat, Eno 2018-13), changing lots on the south side near Vista Avenue. The original Tracts 1, 2, and 3, and small lots were changed and became Tract 2A and Lot 1B; and Tract 4 was changed to 4A. The remainder of Dairy Hill Subdivision remained as Tract 5. Current Acton 2023 requested Replat, Darcy Hill subdivision, Resolution 2023-011, May 9, 2023 It is petitioned, that Tract 5 be replaced into a new plat, made up of three geographic sections; each section being different from the others in its geographical characteristics. Each section is different, in its type of soils, bedrock, and glacial gravels, its grades and slopes, groundwater, wetlands, and drainage patterns, and includes distinctive topography. The three new divisions requested to be created are Tract 5A, Tract 5B, and Tract 5C. Tract 5A is 11.9 acres, the bulk of this tract is located in the lower flat land area between Scheffler creek and Spring creek (Seward Highway). Its area on the South side, near Dairy Hill Lane is wetland; the area on the North side, near Phoenix Rd, is not wetland. The remainder of the Tract 5A lies West of Shuffler Creek and is highland. 1 2 Tract 5A zoning is RM with no change requested, except for a correction in the zoning map to be explained under a separate paragraph below. Tract 5B is 81,436 S.F. and located on dry, sloping ground between Scheffler Creek and Bayview Place. This Tract is to be later offered to a developer for construction of housing that would be compatible with the area and slope. Water service is located on Bayview Place. Sewer service is located in the 30 ft. utility easement on the East boarder this tract. Electric will connect by an existing conduit currently installed under Scheffler Creek from a transformer on the Clearview side, to connect with electric easements to be determined by the City Electric Dept. Tract 5C is 30,749 S. F. located on the slope West of Bayview Place. This tract is currently zoned R-1 and would be offered to a builder for construction several homes. There is no change in zoning. Sewer would be connected to a manhole on the south side of this tract, with water connects from the main line in the street. Development of Tract 5A and 5B Tract 5B and 5C would be created for the purpose of providing land for development targeting family housing. We are desiring the objective to develop toward the creation of affordable, well designed and efficient, two-and three-bedroom family housing with some view and garage. Tract 5A could support possibly 6 to 9 housing units pending design. Tract 5B could support 2 or 3 units. At a later date this tract may be further subdivided into lots if that were needed in a builder's plan. Such an increase in housing, inside the Seward city limits would increase the tax base and help relieve the housing problem. A possible byproduct of better housing is an immigration of younger, virtual, computer savvy, work at home, citizens. Family homes may discourage the Airbnb, situation, so recently debated. We do NOT favor building larger, high-end homes or low-income type units housing. An additional fire hydrant is required and will be installed off Aialik St and Bayview place to meet 250-foot hydrant code. Bayview Place will be extended south about 254 feet with a cul-de-sac at its end. This street will support electric easements. On the East side of Tract 5A there exists the 30-foot-wide sewer easement which may be utilized as access to the housing and for construction. Soils on Tract 5A are of a glacial and gravel type, however, some softer clay topsoil may need to be removed before any building construction. 2 3 The builder company, because of the challenges of the sloping ground, will need to address a buildings design and foundation construction to fit the property. A second challenge is to adequately space and locate the structures on this property in a unified fashion. A one builder approach building on this site, standardizing the design and construction, might minimize and simplify these challenges. This conformity would reduce the construction risk and offer a better product in the end. A one builder approach would be more efficient for supplying labor and materials and the other interior construction that go into housing. The construction could be in phases over several years or as demand dictates. At a later date this tract may be further subdivided into lots if that were needed in a builder's plan. Resolution 2023-012, Rezoning, a portion of Tract 5A Directly south of Tract 5C, there is an area of land, located on Tract 5A, (zoned RM) that is shown on the zoning map as being zoned R-1. On an original town survey, this area at one time was made up of lots that were platted, extending from Bayview addition on the north, to Cliff addition on the south, and all zoned R-1 at some point. Later replating has eliminated these lots, but the R-1 zoning remained. Resolution 2023-012 will remove this R-1 zoning from Tract 5A, which is zoned RM. The original town lots in this area were about 50 % on a steep non-buildable slope that could not be used. In the future, the zoning of the RM status of Tract 5A can be addressed.
