HomeMy WebLinkAboutRes2004-095 I I I Sponsored by: Shealy CITY OF SEWARD, ALASKA RESOLUTION 2004-95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A MAINTENANCE AGREEMENT WITH THE STATE OF ALASKA TO MAINTAIN IMPROVEMENTS TO BE CONSTRUCTED BY THE STATE ON THE CITY'S PORTION OF NASH ROAD BETWEEN MILE POINT 1.9 AND 5.3. WHEREAS, the State of Alaska has agreed to construct improvements on Nash Road as part of its Nash Road MP 0.0-5.3 Rehabilitation Project; and WHEREAS, the State of Alaska has agreed to pay for construction ofthese improvements on the City's portion of Nash Road (MP 1.9-5.3); and WHEREAS, the State of Alaska has requested that the City of Seward assume responsibility for maintaining these improvements on the City's rights of way; and WHEREAS, the citizens of Seward will benefit from an improved and maintained Nash Road in the City of Seward. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is authorized to enter into an agreement with the State of Alaska to maintain improvements on the City's portion of the Nash Road right of way, to be constructed at State expense on Nash Road between MP 1.9 and 5.3. Section 2. The City's obligations under the agreement shall be subject to annual appropriations. Section 3. This resolution shall take effect immediately. COUNCIL AGENDA STATEMENT Meeting Date: September 13, 2004 Through: Phil Shealy, City Manager From: Dave Calvert, Electric Utility Agenda Item: Maintenance Agreement with the State of Alaska BACKGROUND & JUSTIFICATION : The City Administration has worked with the State of Alaska, Department of Transportation and Public Facilities (the "State") to improve Nash Road, including the City's portion of Nash Road (MP 1.9-5.3), as part of the State's Nash Road MP 0.0-5.3 Rehabilitation Project. The State has agreed to construct the improvements at its cost if the City of Seward will agree to maintain them on the City's portion of the road. The attached "Maintenance Agreement" is the result of those negotiations. If Council approves of this project, the improvements are scheduled to begin in spring 2005.
