RESOLUTION 2023-086
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO A
LEASE WITH DUCHESS, LLC FOR LOT 5 BLOCK 6 FOURTH OF JULY
CREEK SUBDIVISION, SEWARD MARINE INDUSTRIAL CENTER,
SEWARD RECORDING DISTRICT, THIRD JUDICIAL DISTRICT,
STATE OF ALASKA
WHEREAS, the City is the owner of real property described as Lot 5 Block 6 Fourth of
July Creek Subdivision; and
WHEREAS, Duchess, LLC has been storing and working on their vessels in the SMIC
yard for several years; and
WHEREAS, Duchess, LLC would like to lease land to expand their business at SMIC;
and
WHEREAS, Duchess, LLC sent in a proposal to lease a section of the unsubdivided
section of Block 6 Fourth of July Subdivision for a boat repair/storage yard, equipment storage;
and
WHEREAS, Duchess, LLC has submitted an application to subdivide Block 6 which
council approved in Resolution 2023-062 creating Lots 4 and 5 Block 6, Fourth of July Creek
Subdivision; and
WHEREAS, Duchess, LLC has submitted an application with the State of Alaska for their
Storm Water Prevention Pollution Plan as required; and
WHEREAS, the Acting City Manager has negotiated a long term lease agreement with
Duchess, LLC under the provisions of Seward City Code 7.05.410; and
WHEREAS, the lease request is consistent with the Comprehensive Plan and the Seward
Marine Industrial Center Plan.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA that:
Section 1. The Council has determined that the essential terms and conditions and the
method of disposition of the proposed lease with Duchess, LLC for the real property described as
the Lot 6 Block 5, Fourth of July Subdivision, located in the City of Seward, is in the public's best
interest.
Section 2. The City Manager is authorized to execute a new lease with Duchess, LLC in

substantially the form as presented at this meeting.
Section 3. This resolution shall take effect thirty (30) days after its adoption.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this 24th
day of July, 2023
