HomeMy WebLinkAboutRes2023-107 UAF CRRC Replat Sponsored OF SEWARD,ALASKA by: Sorensen RESOLUTION 2023-107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, RECOMMENDING THE KENAI PENINSULA BOROUGH APPROVAL OF THE PRELIMINARY REPLAT OF WATERFRONT TRACTS MARICULTURE ADDITION, TRACTS lA & 1B AND WATERFRONT TRACTS, TRACT 2A; LOCATED AT 201, 101, AND 301 RAILWAY AVE; CREATING WATERFRONT TRACTS RESUBDIVISION,TRACTS lA-1, 1B-1,AND 2A-1 WHEREAS, Stantec Consulting Services Inc. has submitted a preliminary plat on behalf of the City of Seward and Chugach Regional Resources Commission (CRRC), University of Alaska Fairbanks(UAF),and the Seward Association for the Advancement of Marine Science dba Alaska SeaLife Center(SAAMS dba ASLC) for review by the City Council and recommendation to the Kenai Peninsula Borough; and WHEREAS, the three tracts are owned by the City of Seward, and leased by the three above stated entities; and WHEREAS,the preliminary plat is proposing minor property boundary changes between the three properties to correctly delineate the land that each organization is using; and WHEREAS, necessary utility and access easements are being established in this preliminary plat; and WHEREAS, on December 12, 2023 the City Council approved Resolution 2022-122 which authorized the City Manager to enter into and execute the purchase and sale agreement and related documents,of which this preliminary plat is included,with CRRC for the sale of 1.52 acres located at 101 Railway Avenue; and WHEREAS, existing Tracts 1 A and 1 B are zoned Institutional and 5.57 acres and 1.57 acres respectively; and WHEREAS,existing Tract 2A is zoned Central Business and 7.39 acres; and WHEREAS, the proposed plat will create Waterfront Tracts Resubdivision, Tracts 1 A-1, 1B-1, and 2A-1; and WHEREAS,proposed Tract lA-1 will be 5.51 acres and continued to be leased by UAF; and WHEREAS,proposed Tract 1 B-1 will be 1.51 acres and sold to CRRC; and WHEREAS, proposed Tract 2A-1 will be 7.49 acres and continued to be leased by SAAMS dba ASLC; and CITY OF SEWARD, ALASKA RESOLUTION 2023-107 WHEREAS,portions of Tract 1 A-1 and 2A-1 are located within a flood zone; and WHEREAS, City water, sewer, electric, and roads are available to all three parcels; and WHEREAS, all conditions required by Seward City Code §16.01.015(C, D, E), Conditions to plat approval, were met; the property owners within 300 feet of the requested replat were notified of the proposed subdivision,and the property was posted with public notice signage; and WHEREAS, City Code §16.01.015(B) states that no preliminary plat of city-owned property may be approved by the Kenai Peninsula Borough planning commission without prior consent of the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA that: Section 1. The Council hereby recommends that, in accordance with Seward City Code Section 16.01.015 (B), the Kenai Peninsula Borough approve the submittal of the preliminary plat of Waterfront Tracts Mariculture Addition, Tracts IA & 1 B and Waterfront Tracts, Tract 2A; Located at 201, 101, and 301 Railway Ave; Creating Waterfront Tracts Resubdivision,Tracts 1A- 1, 1B-1, and 2A-1. All three parcels are owned by the City of Seward,but Waterfront Tracts mariculture Addition Tract IA is leased by UAF and Tract 1B is leased by CRRC.Waterfront Tracts,Tract 2A is leased by the Alaska Sea Life Center. The sale of the parcel that CRRC is currently leasing was approved by the City Council on December 12, 2022 through Resolution 2022-122. The sale of this land requires the placement of certain utility and access easements on the property before the sale can be finalized. The preliminary plat is also proposing minor property boundary changes between the three parcels to more accurately delineate the land that each organization is using. All conditions required by Seward City Code §16.01.015,Conditions to plat approval,were met.The property owners within 300 feet of the requested replat were notified of the proposed subdivision,and the property was posted with public notice signage. In accordance with Borough requirements,the City must review and comment on a plat before submittal to the Borough for approval. Subdivision review: Zoning: Proposed Tract lA-1 and 113-1 are currently zoned Institutional(Ins)and will remain as such. Proposed Tract 2A-1 is currently zoned Central Business(CB)and will remain as such. Size: Tract IA is 5.57 acres and is being platted as Tract IA-1 and 5.51 acres. Tract 1B is 1.57 acres and is being platted as Tract 113-1 and 1.51 acres. Tract 2A is 7.39 acres and is being platted as Tract 2A-1 and 7.49 acres. Utilities: Water, sewer, electricity, and roads are all available to each of the parcels. 128 Exisdnz Use: Tract IA-1 is leased by UAF. Tract 1B-1 will be sold to CRRC. Tract 2A-1 is leased by SAAMS dba ASLC. Access: All three parcels are accessed from Railway Ave. Flood Zone: According to the Kenai Peninsula Borough Floodplain map,portions of Tract IA-1 and 2A-1 are within an AE and VE Flood Zone.
