A resolution authorizing a Perpetual Easement to be
granted to the State of Alaska, Department of Public Works,
Division of Aviation, for its exclusive control, use, and juris-
diction to airspace in conformity with Federal Aviation Agency
criteria, over certain tidelands and submerged lands situated
within Alaska Tidelands Survey No. 174, patented to the City of
Seward. Said Perpetual Easement to be determinable only upon
abandonment of the Northwest/Southeast Runway by the Grantee, its
successors or assigns.
Be it resolved by the City of Seward, Alaska, that:
WHEREAS, the City of Seward and its environs has been
provided with an extension to said Northwest/Southeast Runway
in the direction of Resurrection Bay, and
WHEREAS, the State of Alaska, Department of Public Works,
Division of Aviation, did construct said extension and
WHEREAS, the City of Seward has received title to the

tidelands and submerged lands encompassed within A~ 174, under
HTS
Patent No. 168 from the State of Alaska, and
WHEREAS, the Division of Aviation, before obtaining
Federal Aid for construction of said extension must have exclusiv
control, use, and jurisdiction to airspace, meeting Federal
Aviation Agency criteria described in Paragraph 1 above, over
the tide and submerged lands immediately to the south of said

runway for the protection of the approach and departure zone to
said runway, and further described as follows:
Beginning at the northwest corner of the
tract herein described, also designated as Corner
No.1, whence the Seward East Base U.S.C. and
G.S. Triangulation Station bears N 12053' E at a
distance of 969.97 feet; thence N 83027'45" E,
456.43 feet to Corner No.2; thence S 70032'20" E,
461.93 feet to Corner No.3; thence N 80012'45" E,

22.40 feet to Corner No.4; thence S 39 35' E,
430.39 feet to Corner No.5; thence S 10000' W,
1,363.58 feet to Corner No.6; thence N 28009' W,
2,010.54 feet to Corner No.1, the place of
beginning containing 23.594 acres of land, more
or less.
FURTHER, should the City of Seward acquire additional
tide and submerged lands now under application with the Alaska
Division of Lands, it will convey airspace above said tide and
submerged lands in accordance with Federal Aviation Agency
criteria referred to above.
FURTHER, no growth or structures shall be permitted into
said airspace area except to the extent not inconsistent with
Federal Aviation Agency criteria now existing or which may
hereafter be duly adopted by the said agency from time to time,
and should there be an intrusion of this area inconsistent with
such criteria by structures or growth, the Division of Aviation
will have a right of ingress and egress to and from the land or
waters beneath such airspace, and to take such steps necessary
to cause their conformity to such criteria or, if necessary,
remove such structures or growth.

NOW THEREFORE, it is hereby resolved that the City of
Seward, Alaska, grant a Perpetual Easement to the State of Alaska~
Department of Public Works, Division of Aviation, to give it
exclusive control, use and jurisdiction to the above-described
airspace determinable only by abandonment of said Northwest/
Southeast Runway, by the Grantee, its successors, or assigns;
and the Mayor is hereby authorized and directed to sign such
Perpetual Easement on behalf of the City, except that this
Perpetual Easement shall not be construed to prohibit the use or
occupancy of, including improvements within, airspace above the
premises described herein consistent ~7ith Federal Aviation
clearance criteria now existing or which may hereafter be duly
adopted by the said agency, from time to time, provided that all
such improvements shall be erected without risk to the State of
Alaska, its Division of Lands, the Federal Aviation Agency, or
their successors and assigns, in the event that such improvements
shall fail to meet clearance criteria in existence at the time
of such construction or subsequently adopted, it being the intent
hereof that the Divison of Aviation in causing such structures
or improvements to conform to Federal Aviation Agency criteria,
or when necessary, in removing such structures, shall incur no
liability by reason thereof.
The Mayor is also authorized and directed to issue a
letter of intent to the Division of Aviation in conformity
herewith.
