RESOLUTION NO. 766
WHEREAS, the CITY OF SEWARD is the owner of Jesse Lee
Heights Subdivision, and
WHEREAS, NORMAN WAGGEY has constructed a residence in
Jesse Lee Heights Subdivision on land purchased from the CITY
OF SEWARD, and

WHEREAS, there ~ no sewer and water facilities available
in such subdivision, and
WHEREAS, it is planned in the future that sewer and water
facilities will be established in the Jesse Lee Heights Subdivision,
and a proper assessment district for such improvements will be
set up, and
WHEREAS, an emergency situation now exists at the residence
as constructed because of the absence of water for the occupants
thereof,
NOW, THEREFORE, BE IT RESOLVED by the Council of the CITY
OF SEWARD that a waterline may be constructed by the DEPARTMENT
OF PUBLIC WORKS of the City to the residence constructed by
NORMAN WAGGEY because of this special emergency,
BE IT FURTHER RESOLVED that such construction shall not
commence until such time as said property owner agrees in writing
that he will pay the proportional cost of such improvement for
water and sewer at the time the assessment district for all other
lots in the Jesse Lee Heights Subdivision is set up.
This Resolution shall be effective on the date of passage
and approval --
