HomeMy WebLinkAboutRes2003-037 I I I Sponsored by: Erchinger CITY OF SEWARD, ALASKA RESOLUTION 2003-037 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AN AMOUNT NOT TO EXCEED $60,000 TO REIMBURSE THE DEVELOPER FOR A PORTION OF THE COST OF INSTALLATION AND UPGRADE OF THE WATER MAIN IN THE NORTH BOAT HARBOR, AND APPROPRIATING FUNDS WHEREAS, a $6 million private hotel development project is under construction on the east side of Fourth Avenue in the harbor, necessitating the movement of utilities located underneath the building as a condition of a Conditional Use Permit (CUP) issued by the Planning and Zoning Commission; and WHEREAS, the developer could move the utilities 30 feet from the proposed building and provide the City with a utility easement across the subject property to satisfy one condition of the CUP, but the City prefers that the developerrelocate the water main out into the City's existing right- of-way and upgrade the size of the water main in order to move the water main off of private property and improve the water infrastructure in the harbor area; and WHEREAS, the existing water main is very old and has suffered a number of recent failures, and due to the increased development in the small boat harbor, it would be beneficial to upgrade the size and location of the water main; and WHEREAS, there are a number of advantages to the City of agreeing to reimburse the developer for a portion ofthe costs required to relocate and upgrade the water line, including: better fire flows resulting from installing a larger size pipe; eliminating isolation problems by installing two main line valves; moving the water main off of private property and into the City's right-of-way; coordinating the new installation and upgrade with the Department of Transportation's road and sidewalk improvements; eliminating future costs associated with tearing up and rebuilding the new road and sidewalks in order to install a water line; and the ability to share the costs of providing improved water infrastructure to the harbor area with the private sector; and WHEREAS, the developer of the project is seeking competitive bids from at least four contractors and will select the lowest qualified responsible bidder to complete this portion of the hotel project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: CITY OF SEWARD, ALASKA RESOLUTION 2003-037 Section 1. The city manager is authorized to negotiate an amount not-to-exceed $60,000 to reimburse the developer for a portion of the costs of installation and upgrade of the water main located in the north boat harbor, being done in connection with the construction of a private hotel project, subject to the water line installation passing a satisfactory inspection by the City and other terms and conditions as may be required by the City for such reimbursement. The city manager is also authorized to negotiate and execute agreements to effectuate the intent of this resolution. Section 2. The amount of $60,000 is hereby appropriated from the Water and Sewer Enterprise Fund Retained Earnings account number 701-0000-3050 to the Water Infrastructure Account number 701-7400-5925. Section 3. This resolution shall take effect immediately. PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this lOth day of April, 2003.
