HomeMy WebLinkAboutRes2003-059 Sponsored by: Erchinger I CITY OF SEWARD, ALASKA RESOLUTION 2003-59 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROVING AMENDMENT NUMBER 2 TO LEASE RE-94-093, LOT 1, BLOCK 8, FOURTH OF JULY CREEK SUBDIVISION, AUTHORIZING THE FIRST OF THREE PERMITTED FIVE YEAR EXTENSIONS. WHEREAS, in October of 1994, the City of Seward City Council approved Resolution 94-209 approving a long term lease of a portion of Lot 3, Block 8, SMIC Fourth of July Creek Subdivision to McCaw Cellular Communications, Inc. dba Cellular One ("Cellular One"); and WHEREAS, AT&T Wireless Services of Alaska, Inc. ("AWS"), as successor to Cellular One desires to exercise, according to the provisions of the lease, the first of three permitted five year extensions; and WHEREAS, the City Council has determined that a long term lease to A WS for the purposes of operating a cellular communications site continues to be in the public interest. I NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The above recitals are incorporated herein by this reference. The first five year extension of the long term lease, Lease Number RE-94-093, to A WS as reflected in Lease Amendment Number 2, in substantial form as attached hereto and incorporated by reference, is approved. Section 2. The City Manager is authorized to execute Lease Amendment Number 2 to Lease Number RE-94-093 on behalf ofthe City. Section 3. This resolution shall take effect thirty (30) days after adoption and posting. PASSED AND APPROVED by the City Council of the City of Seward, Alaska this 9th day of June, 2003.
