RESOLUTION 2003-65
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, APPROVING THE USE AGREEMENT
BETWEEN THE CITY AND THE ALASKA VOCATIONAL
TECHNICAL CENTER
WHEREAS, the Student Services Center facility provides a viable recreation site for the
public in a variety of programs including: roller skating, youth basketba1l1eagues, youth and
adult open gym, adult basketball, wallyball, volleyball and racquetball leagues and programs,
weight lifting, aerobics and other special programs; and
WHEREAS, the City Parks and Recreation Department has been negotiating with the
Alaska Vocational Technical Center to provide public use at the A VTEC Student Services
Center; and
WHEREAS, the A VTEC student population, families of students, staff and faculty of
A VTEC and their families also benefit from various programs offered through the SCC; and
WHEREAS, the 2003 budget approved by the City Council ret1ects the program hours,
associated expenses and projected uses set forth in the Use Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEWARD, ALASKA, that:
Section 1. The Use Agreement between the City of Seward and the Alaska
Vocational Technical Center through June 30, 2006 is hereby approved.
Section 2.
Two one-year extensions may be approved by the city manager.
Section 3.
This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council ofthe City of Seward, Alaska this 23rd
day of June 2003.

BACKGROUND & JUSTIFICATION
The City of Seward has long enjoyed the benefits of providing community recreation
programs through the AVTEC Student Service Center to the public. The following, new Use
Agreement offers minor amendments and is recommended by staff for approval. The City
attorney did review the later drafts of the proposals.
A major change is extending the Use Agreement from a one-year time frame to a three-
year Agreement, with two, one-year extensions, to be authorized by the City Manager if no
major changes are proposed. Minor changes include: A. Identifying a pro-rate
compensation for times when the AVTEC Administration closes the building to public use
(Rural Cap conference, Health Fair, etc...); B. Further level of bureaucracy if/when
maintenance items are not dealt with by AVTEC; and C. Deadlines placed on both entities
to expedite the selection and purchase of the items for Equipment Credit.
The financial impacts of the Use Agreement remain fairly constant. The City of Seward will
continue to pay for the contracted custodial care of the downstairs portion of the SCC,
including cleaning the gameroom area unavailable to members of the public. In addition,
the City will participate in the Equipment Credit program, which allows for the purchase of
new workout equipment or facility improvements, which become the property of AVTEC.
