HomeMy WebLinkAboutRes1982-028 5/10/82 FBA/rsa CITY OF SEWARD, ALASKA RESOLUTION NO. 82-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, REGARDING APPROVAL OF CONTRACT CHANGE WITH ARCTIC ENGINEERS, INC. WHEREAS, Arctic Engineers, Inc., f/k/a Arctic Engineers, has an existing contract with the City of Seward for the design and construction management of the Seward Interceptors and Waste Water Treatment Facilities Project, CPA No. C020051-03, and WHEREAS, certain delays have been caused in that project, and WHEREAS, there have been particilar problems with pump stations 1 and 3 but those difficulties have been resolved by agreement with the contractor, Brown & Associates, a joint venture, and with Arctic Engineers, Inc., by letter agreement dated April 14, 1982, and WHEREAS, under the terms of those agreements, the Ci ty of Seward is to bear no cost for the repairs and modifications necessary to pump stations 1 and 3 either by reason of redesign and construction management, or actual construction thereof, and WHEREAS, the Department of Environmental Conservation, State of Alaska, on behalf of the Environmental Protection Agency, has agreed to the agreement between the City of Seward and the contractor and engineer by letter dated April 9, 1982, and WHEREAS, the project is, or will be, complete in the very ,- near future, and WHEREAS, Arctic Engineers, Inc., has agreed to conclude all work on the project at no further cost to the City of Seward beyond those costs originally estimated in its contract plus the additional costs incurred prior to the failure of pump stations 1 and 3, and WHEREAS, the Department of Environmental Conservation has agreed that the costs to the City in terms of anrninistration and attorneys' fees will be eligible for grant funds, and WHEREAS, the Ci ty and Arct ic Enq ineers, Inc., have agreed that an increase in the contract in the' amount of FIFTY-THREE THOUSAND THREE HUNDRED FIFTY-FIVE AND 26/100 DOLLARS ($53,355.26) is necessary to adequately reflect work performed and to be performed under the contract. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: -1- r I I I I CITY OF SEWARD, ALASKA RESOLUTION NO. 82-28 Page 2 Section 1. The existing not-to-exceed price of THREE HUNDRED SIXTY-SEVEN THOUSAND SEVEN HUNDRED FORTY-THREE AND NO/lOO DOLLARS ($367,743.00) with Arctic Engineers, Inc., be increased to FOUR HUNDRED TWENTY-ONE THOUSAND NINETY-EIGHT AND ~6./l00 DOLLARS ($421,098.26"-), representing an increase of FIFTY-THREE THOUSAND THREE HUNDRED FIFTY-FIVE AND 2Q1l00 DOLLARS ($53,355.2EB). Section 2. This increase and the payment thereof represents a final and complete payment to Arctic Engineers, Inc., for services performed but does not act as a release by the City of Seward of Arctic Engineers, Inc., for any disputes or disagreements not covered in the letter agreement dated April 14, 1982, between the City and Arctic Engineers, Inc.
