HomeMy WebLinkAboutRes1982-047 r I i 6/17/82 FBA/rsa CITY OF SEWARD, ALASKA RESOLUTION NO. 82-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROVING AN AWARD OF CHANGE ORDER NO. 1 TO THE SPRING CREEK CLEARING AND RELOCATION PROJECT, NO. 242000. WHEREAS, the Spring Creek clearing and relocation project contract has been awarded to Stephan & Sons, Inc., and includes the clearing and removal of stumps, brush, and slash from the Spring Creek area located north of the developing Seward Marine Industrial Center, and WHEREAS, it is in the public interest of the City of Seward to expand the area available for use by industry, and WHEREAS, organic cover will user areas, and the stripping of an upper silt layer and be necessary for the developMent of additional WHEREAS, prior to the commencement of the contract for the clearing and relocation, it was difficult, if not impossible, to determine the extent of stripping necessary, and WHEREAS, the same equipment used for the clearing and relocation project can be utilized for the stripping and removal of organic cover, and WHEREAS, Stephan & Sons, Inc., has proposed a price per cubic yard of $2.70 for removal of all stripping materials based upon an estimate of 22,000 cubic yards within a 6.4 acre parcel is less than the price paid by the City in a similar contract ($3.00 per cubic yard for Phase III construction by Chris Berg, Inc., after competitive bidding), and WHEREAS, the current construction near Spring Creek provided additional information which makes possible the computation of expected stripping quantities which were not possible prior to the award of the clearing and relocation contract which itself was not capable of being awarded by reason of U.S. Army Corps of Engineers I permit restrictions prior to June 1, 1982, and WHEREAS, going to public bid prior to the present time and therefore prior to the current information having been developed would have most likely resulted in even higher bid estimates by reason of bidder uncertainty of site conditions and equipment requirements, and WHEREAS, mobilization for future stripping operation would, in the opinion of the City and Project Engineer, exceed $10,000.00, and -1- r I I I i I CITY OF SEWARD, ALASKA RESOLUTION NO. 82-47 WHEREAS, it will be less expensive for the City to supervise the operation of a single large contract covering both stripping and clearing and the City Engineer has estimated such savings to be in excess of $10,000.00, and WHEREAS, it would cost in excess of $3,000.00 to go through the pUblic bidding process, and WHEREAS, it is possible that there may be additional savings by use of hydraulic fill from the current project with Chris Berg, Inc., for filling after stripping has occurred which savings would not be possible were the stripping to be delayed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. Change Order No. 1 be awarded to Stephan & Sons, Inc., in an amount not to exceed FIFTY-NINE THOUSAND FOUR HUNDRED AND !'YO/looms DOT.T,ARS (S 59.400.00 ) for stripping of the Sprlng Creek area adjacent to the Seward Marine Industrial Park in accordance with the proposed Change Order No. 1 reviewed by the City Council on June 21, 1982. Section 2. The City Council finds that the public bidding requirements of Section 10-8(a) are not necessary for the reasons set forth above and that the public interest would be best served by not requiring competitive bidding for the reasons set forth above.
