Council CITY OF SEWARD, ALASKA RESOLUTION NO. 77-36 A RESOLUTION SETTING FEES FOR THE SEWARD MUNICIPAL BOAT HARBOR FACILITIES AND REPEALING RESOLUTIONS IN CONFLICT HEREWITH Be it resolved that Resolution No. 671 passed and approved by the City Council of the City of Seward the 22nd day of December, 1967, and amended by Resolution 675 passed by the City Council of the City of Seward on the 18th day of January, 1968, and all other resolutions in conflict herewith are hereby repealed and that mooring and other charges for use of the Seward Municipal Small Boat Harbor and its facilities shall be as follows: SECTION 1. Mooring Rental Charges: Small Boat Harbor: (a) For rental of the below described mooring berths the designated charges shall be made with all such charges due and payable in advance. Daily: (1) Vessels thirty-two feet (32') and under $2.00 per day (2) Vessels over thirty-two feet (32') up to sixty-four (64') $4.00 per day (3) Vessels over sixty-five feet up to eighty-five feet (85') $6.00 per day (4) Vessels over eighty-five feet (85')$8.00 per day r -2- B. Yearly: The annual moorage rate for open moorage is 75% of the annual rate for preferential moorage as established by the length of vessel or length of float. At City Dock (a) The City Dock is hereby declared a working dock and all moorage shall be on the basis of daily rate set as follows: (1) Vessels thirty-two (32') and under $2.00 per day (2) Vessels over thirty-two feet (32') up to sixty-four (64') feet $4.00 per day (3) Vessels over sixty-four feet (64') up to eighty-five feet (85') $6.00 per day (4) Vessels over eighty-five feet (85')$8.00 per day (b) No vessels shall be permitted to moor in excess of fourteen days at the City Dock without prior express permission from the Harbormaster. (c) Cargo loading or unloading shall have priority use of the City Dock at any and all times. SECTION 2. Grid Rental Charges: (a) Grid rental rates: 1. First 72 Hours or Portion Thereof: Charge Per Day a. Vessels less than twenty-four feet (24') in length: $ 5.00 b. Vessels twenty-four feet (24') or more in length but less than thirty-two feet (32'): $10.00 c. Vessels thirty-two feet (32') or more in length but less than forty-five (45'): $20.00 d. Vessels forty-five feet (45') or more in length but less than sixty feet (60'): $25.00 r- .... -3- e. Vessels 60 feet or more in length but less than 75 feet: $35.00 f. Vessels 75 feet and over: $50.00 2. Daily Charge After the First 72 Hours: a. .Vesse1s less than 24 feet in length: $10.00 b. Vessels 24 feet or more in length bltless than 32 feet: $20.00 c. Vessels 32 feet or more in length but less than 45 feet: $40.00 d. Vessels 45 feet or more in length but less than 60 feet: $50.00 e. Vessels 60 feet or more in length but less than 75 feet: $70.00 f. Vessels 75 feet and over: 100.00 (b) The Harbormaster shall issue written permission for use of the grid and no boat shall be moored on to the grid until such permission has been granted as the grid use shall be on a first come, first serve basis. SECTION 3. Upland Storage Rental Charges: Upland storage of boats or boats on trailers or cradles shall be at the rate of fifteen dollars ($15) per boat, trailer or cradle per month. SECTION 4. Boat Lift Charges: (a) The following charges shall be made for use of the Boat Lift facility during the hours and times specified: 9:00 a.m. to 4:00 p.m., daily except Tuesdays and Thursdays. $1.00 per foot (actual length) for launching or removing from water to staging area only, plus fifteen dollars ($15) an hour or any part thereof. "- ~~ -4- 4:00 p.m. to 9:00 a.m., daily and holidays: $1.00 per foot (actual length) for launching or removing from water to staging area only plus fifteen dollars ($15) an hour or any part thereof, plus labor overtime charges. (b) A fifteen dollar ($15) penalty for leaving the immediate area of the City boat yards shall be assessed. (c) City personnel only shall operate the Boat Lift. (d) Vessel owners or agents or any owner desiring to have vessels lifted out of or placed in the water shall sign an application and make payment before the work is done. (e) No person shall remain on any vessel while same is being removed or placed in the water. (f) In cases when a boat is raised and owner desires to have same remain in the slings while repairs or inspections are being made, this shall constitute two lifts for the purposes of determining charges. This service shall be available only when the boat lift is not needed for other boats or services. SECTION 5. Labor and Service Charges: Service and labor performed by the Harbormaster or any City employee working in the Harbor shall be as follows: (a) Labor shall be charged for at the rate of $12.00 per man per hour, with a two hour minimum callout. (b) Pumping of boats which are in danger of sinking shall be charged a rate of five ($5) dollars per hour, plus labor costs. (c) Replace mooring lines that have become unsafe or broken: Labor costs plus costs of mooring line. (d) Charges to move or tow boats: Twenty ($20) dollars per boat plus labor costs. (e) City supplies: Any City supplies not expressly provided for above shall be reimbursed the City at their cost to the City. r -5- SECTION 6. Service Charge For Use of City Dock Facilities: Service charge is the charge assessed against vessels, their owners, agents, or operators, which load or dis- charge cargo at the City dock, for performing one or more of the following services: (Subject to Notes A,B,C,D,E) (1) Providing terminal facilities (2) Arrange berth for vessel (3) Arrange terminal space for cargo (4) Lighting terminal Note "A" Service charge does not include any freight handling, loading or unloading operations, nor any other labor than providing the services. Note "B" Service charges not assessable on raw fish discharged for the purpose of processing in processing facilities located within the City.* Note "c" Charge shall not apply on the loading and unloading of fishing gear or equipment or supplies connected with commercial fishing. Note "D" The City of Seward reserves the right and privilege to waive service charges at its discretion when it appears to be in the best interest of the City. Note "E" Service charge rates: Rates apply on cargo loading from or to vessels except as otherwise provided. Wharfage Definition: Wharfage is the charge against merchandise for its passage, over, under, or through any wharf, pier, or other docking facility, or loaded or discharged over- side vessels berthed at wharf, pier, td other docking facility owned or controlled by the City of Seward. Application of Wharfage Charges: Wharfage rates named will be assessed on all merchandise except as follows and is in addition to other charges named: (a) Merchandise on which wharfage has been assessed may be reshipped from same wharf without further assessment or wharfage provided the merchandise is not removed from the wharf while awaiting trans-shipment. (b) Merchandise discharged or loaded overside of vessel directly to or from another vessel or to the water when vessel is berthed at wharf will be assessed one-half the wharfage rates named herein. (c) Exempt from charges; Overs towed cargo (defined as cargo deSined for discharge at another port that a vessel must place on wharf and reload) also exempt ships gear necessarily discharged and re- loaded before the vessel departs. Wharfage Rates: Except as otherwise provided rates apply per ton of 2,000 pounds as manifested by vessel for revenue purposes or per 1,000 feet board measure as applicable to poles, piling, lumber, logs, or cants. Terms for Use of City Dock or Wharf: The use of wharves, docks or facilities shall be deemed an acceptance of the terms and conditions named herein. (a) Vessels discharging or loading cargo at any City owned or controlled wharf, pier or facility must furnish the City of Seward a complete manifest of cargo, or at the City's discretion may furnish in lieu there- of, freight bills and abstracts covering all freight shipments to be discharged prior to commencement of discharging or loading operations. (b) Delays in loading, unloading, receiving, delivering or handling merchandise arising from combinations, riots, or strikes of any person in the employee of the City or in the service of others, the failure or breakdown of terminal mechanical equipment, delays arising from any other cause not reasonably within the control of the City, will not entitle the owners, shippers, con- signees, or carriers of merchandise to waiver of any terminal charges or expense that may be incurred. (c) Rate named does not include any insurance. (d) The City of Seward will not be responsible for any loss or damage caused by fire, frost, heat, dampness, leakage, the elements, evaporation, natural shrinkage, wastage, decay, animals, rats, mice or other rodents moths, weevils or other insects, leakage or discharge from fire protection systems, col- lapse of buildings or structures, breakdown of plant or machinery equipment, or by floats, logs or piling required in breasting vessels away from wharf; nor will it be answerable for any loss, damage or delays arising from insufficient notification or from war, insurrection, short- age of labor, combinations, riots or strikes of any persons in its employ or in the service of others or from any consequence arising therefrom. r -8- (e) Damage to the wharf, dock or their appurtences or property, caused by any vessel or personnel will be the responsibility of the company or person using same. Charges for repairs to damaged property will be at cost plus reasonable charge for delays occasioned by damage. Labor performed to keep property in clean and orderly manner, when not left clean by parties using, will be charged for at cost plus 20 per cent. (f) The right is reserved by the City without responsibility for loss or damage attaching, to refuse to accept, receive, unload or permit vessel to discharge; (1) Merchandise for which previous arrangements for space, receiving, unloading or handling have not been made with the City by consignee or owner. (2) Hazardous or offensive merchandise or merchan- dise which by its nature is liable to damage other merchandise, is subject to immediate removal either from the wharf or dock premises toother locations within said premises with all etpenses and risks of loss or damage for the account of the owner, shipper, or consignee. (g) Merchandise left on wharf or dock premises may be removed to private or public warehouses with all expense or removal and risk of loss or damage for account of the owner, shipper, or consignee, or carrier, as responsibility may appear. (h) Right is reserved by the City of Seward to withhold delivery of merchandise until accrued terminal charges against said merchandise have been paid. SECTION 9. Beach Loading: There shall be no barge or vessel loading from the beach within the dredged Small Boat Harbor. SECTION 10. Rules and regulations governing the Seward Municipal Small Boat Harbor as specified in Chapter 5 of the Seward Code are hereby made a part of this resolution the same as if they were specifically printed into the resolution. r" -9- SECTION 11. All moorage or rental fees described herein are due in advance on reservation of the berth or facility and there- after on or before the first day of the month. Failure to pay the moorage or rental fee in advance by the first day of the month shall cause the account to become delinquent and therupon a delinquent penalty in the amount of l~ per cent per month imposed. SECTION 12. Use of Boat for Permanent Living Quarters A permit must be obtained from the Harbormaster and a fee of twenty ($20) dollars per month or fraction thereof paid for use of a boat for permanent living quarters. SECTION 13. This resolution becomes effective October 19, 1977. PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 10th day of October , 1977.
