HomeMy WebLinkAboutOrd1996-028 I I I Sponsored by: Garzini Introduction Date: October 14.1996 Public Hearing Date: October 28 1996 CITY OF SEWARD, ALASKA ORDINANCE NO. 96-28 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING SEWARD CITY CODE SECTION 14.05.015 REGULATING THE USE OF DUMPSTERS AND TRASH RECEPTACLES IN PUBLIC AREAS WHEREAS, there has been a significant increase in the use of public dumpsters located in the small boat harbor, city parks and other locations on public property; and WHEREAS, although a portion of the increased use of the dumpsters can be attributed to growing numbers of tourists visiting the City, a large amount of the additional garbage is deposited by community members disposing of residential garbage; and WHEREAS, local business owners have also complained that area residents are using their commercial dumpsters for residential garbage disposal; and WHEREAS, there are currently no City Code provisions prohibiting this practice; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. Seward City Code SI4.05.015 is hereby amended by adding new Subsections B, C and D to read as follows: 14.05.015 Deposit of refuse. A. B. Dumpsters or trash receptacles located on public property may only be used for depositing small quantities of refuse generated in connection with public activities such as picnicking, camping, touring, pleasure boating, sport fishing, or other outdoor recreation. No person shall deposit refuse generated by residential, commercial, or industrial uses in or near any dumpster or trash receptacle located on public property. No person shall deposit refuse in or near any dumpster or trash receptacle located on public property contrary to any instructions posted on or near the dumpster or trash receptacle. C. No person shall deposit refuse in a private dumpster without the owner's consent. Owners of dumpsters may post signage on or near privately owned dumpsters stating that unauthorized use is a violation of the City Code. CITY OF SEWARD, ALASKA ORDINANCE NO. 96-28 D. offense. Violation of this section is subject to a fine of $100.00 for each Section 2. This ordinance shall take effect ten (10) days following its enactment.
