RESOLUTION 2003-103
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO
ENTER INTO AN AGREEMENT WITH TRYCK NYMAN HAYES,
INCORPORATED (TNH) FOR PRELIMINARY ENGINEERING
SERVICES FOR THE EAST HARBOR EXPANSION PROJECT
FOR AN AMOUNT NOT TO EXCEED $355,571
WHEREAS, the City of Seward has long pursued the expansion of the Small
Boat Harbor; and
WHEREAS, in 1998, the U. S. Army Corps of Engineers, Alaska District,
(USACE) completed a Feasibility Study and an Environmental Assessment for the
project, both of which were approved in 1999; and
WHEREAS, in June of 2003, TNH completed a comprehensive long range plan
involving an extensive public involvement process spanning nearly a year. This Harbor
Area Planning and Development Guide was approved on August 11, 2003 by City
Council Resolution 2003- 84 and includes the East Harbor Expansion as a component;
and
WHEREAS, Council has indicated their satisfaction with TNH's work to date on
harbor projects and directed staff to pursue their proposal for engineering services for the
East Harbor Expansion Project; and
WHEREAS, TNH has submitted their task proposal for the first three (of six)
tasks associated with the East Harbor Expansion Project. These tasks include Design
Development, Float Procurement and Preparation and Management of the installation
contract; and
WHEREAS, the final tasks, task 4-6, will be submitted for approval as more
specific information is gathered during tasks 1-3; and
WHEREAS, per City of Seward Code of Ordinances 96.10.120, Engineering
Services are professional services and exempt from competitive procurement procedures.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to enter into an agreement with TNH
for engineering services as described in the proposal, attached hereto and incorporated by
reference, for an amount not to exceed $355,571 for Tasks 1-3.
Section 2. $355,571 is appropriated from the Harbor Eastward Expansion Fund,
account number 274-0000-3050 to pay for this professional service.
Section 3. This resolution shall take effect immediately upon adoption.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska
this 27th day of October, 2003.

Agenda Item: Authorizing the City Manager to Enter into an
Agreement with Tryck Nyman Hayes, Incorporated
(TNH) for Preliminary Engineering Services for the East
Harbor Expansion Project for $323,571.
BACKGROUND & JUSTIFICATION:
The City of Seward has long pursued the expansion of the Small Boat Harbor. In 1998, the U. S.
Army Corps of Engineers, Alaska District, (USACE) completed a Feasibility Study and an
Environmental Assessment for the project. The Feasibility Study was favorable and the project was
approved in FY1999.
In June of 2003, TNH completed a comprehensive long range plan involving an extensive public
involvement process spanning nearly a year. This Harbor Area Planning and Development Guide was
approved on August 11, 2003 by City Council Resolution 2003-84 and includes the East Harbor
Expansion as a component.
Council has indicated their satisfaction with TNH’s work to date on harbor projects and directed staff
to pursue their proposal for engineering services for the East Harbor Expansion Project. TNH has

Per City of Seward Code of Ordinances §6.10.120, Engineering Services are professional services and
exempted from competitive procurement procedures.

FISCAL NOTE:
A $355,571 (which includes a $32,000 contingency amount) appropriation is required from the
Harbor Eastward Expansion Fund, account number 274-0000-3071-0 to pay for this professional
service. These funds will come from the grant monies obtained from the State of Alaska Department
of Transportation and Public Facilities.

RECOMMENDATION:
Council approves Resolution 2003-103 authorizing the CityManager to enter into an agreement with
TNH for Preliminary Engineering Services for the East Harbor Expansion Project for an amount not
to exceed $355,571, and appropriating funds.
