HomeMy WebLinkAboutOrd1997-002 I I I Sponsored by: Garzini Introduction Date: January 27 1997 Public Hearing Date: February 10 1997 CITY OF SEWARD, ALASKA ORDINANCE NO. 97-02 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, ADOPTING THE 1996 NATIONAL ELECTRICAL CODE, THE 1994 UNIFORM BUILDING CODE, WITH CERTAIN EXCEPTIONS; AND THE 1994 UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS WHEREAS, various national uniform code updates have been adopted by the State of Alaska; and WHEREAS, it is in the public interest for the City to follow suit in adopting these Codes with certain exceptions to comply with exceptions noted by the state and to meet local needs; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. Seward City Code Section 12.05.010 is hereby amended to read as follows: 12.05.010 Uniform Building Code adopted. A. The Uniform Building eode, 1994 edition, as on file with the city clerk, published by the International eonference of Building Officials, is hereby designated and shall be known as the Seward building code and shall constitute the laws of the city relating to building regulation. Although not published in full in this section, all of the provisions of the Uniform Building eode, except as provided in Subsection D. below, shall be and are hereby adopted by reference to the same extent as if set forth in full in this section, except to the extent that the Uniform Building eode shall be in conflict with this code or any relevant ordinance later adopted, in which case the provisions of this code shall prevail. B. The city clerk is directed to keep on file at least three copies of the Uniform Building Code, 1994 edition, for public use, inspection and examination, so long as the provisions thereto remain in force. C. It shall be unlawful for any person to erect, construct, enlarge, alter, repair, move, remove, improve, convert, demolish or equip any building or structure in the city, or cause or permit the same to be done, contrary to or in violation of any of the provisions of the Uniform Building Code adopted and incorporated as the Seward Building Code by this section. Section 2. A new Section 12.05.010 D. is hereby enacted to read as follows: D. The Uniform Building Code, 1994 edition, adopted in Subsection A. above, is hereby amended by adopting the following exceptions to the code: CITY OF SEWARD, ALASKA ORDINANCE NO. 97-02 1. Section 105, Board of Appeals, is deleted. 2. Section 305.1, Division 3, is revised to read: Division 3. Any building, or portion of a building, used for day care purposes for more than 6 persons, including children under the age of 12 related to the staff. 3. Section 305.2.3 is revised by adding a new paragraph to read: Group E, Division 3 Occupancies that operate between the hours of 10 p.m. and 6 a.m. shall be equipped with approved automatic sprinkler system throughout, designed and installed in accordance with NF.P.A. Standard 13D-1994 or approved equiva- lent system. 4. Section 305.2.3, Exceptions, is revised by adding the following paragraphs to read: 4.0 Family child care homes operating between the hours of 6 a. m. and 10 p. m. may accommodate a total of eight children without conforming to all the requirements of this regulation except for smoke detectors as specified in Subsection 310.9; exiting, including operable windows in napping or sleeping rooms as specified in Subsection 310.4; andfire extinguisher requirements. 5.0 Day care facilities that are operated in a primary residence between the hours of6 a.m. and 10 p.m. accommodating up to a total of 12 children may use the second story of the building without complying with Section 305.2.3, Exception 2, Table 5-1, and the type V-I hour requirements set out in Table 5-B provided all other code provisions for E-3 occu- pancy are met. 5. Section 904.2.4.1 is revised by the deletion of exceptions 1 and 2. 6. Section 1006.9 is revised by the addition of the following paragraph: In stairways serving a Group E, Division 3 Occupancy, additional handrails located midway, plus or minus two inches, between the normal handrails and the nosing of the treads, shall be provided if the stairway serves as an exit for children five years of age or younger. The additional handrails shall be 1-1/4 inches in cross-sectional dimension. 7. Appendix Chapter 15 is revised by deleting Section 1515, calling for inspection of a roof prior to re-roofing. 8. Appendix Chapter 34, Sections 3406.1 and 3413 respectively are revised by adding a second paragraph to read: -2- I I I CITY OF SEWARD, ALASKA ORDINANCE NO. 97-02 The provisions of this division may not be construed to allow the elimination of fire protection systems or a reduction in the level offire safety provided in buildings constructed in conformance with previously adopted codes. 9. Appendix Chapter 34, Section 3417, Appeals Board, is deleted Section 3. Seward City Code Section 12.05.015, Dangerous Building Code adopted, is hereby amended by deleting any references to the "1991 edition" and inserting in its stead the "1994 edition." Section 4. Seward City Code Section 12.05.035, National Electrical Code adopted, is hereby amended by deleting any references to the "1990 edition" and inserting in its stead the "1996 edition." Section 5. This ordinance shall take effect ten (10) days following its enactment. ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 10th day of February, 1997.
