RESOLUTION 99-003
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROVING AN EXTENSION OF THE SETTLEMENT
AGREEMENT DATED JUNE 11, 1996, WITH FRANK IRICK
CONCERNING DELINQUENT SPECIAL ASSESSMENTS ON LOTS 1SA
AND ISB IN THE JESSE LEE HEIGHTS SUBDIVISION ADDITION NO.4
WHEREAS, the City of Seward (the "City") has levied special assessments on Lots 15A and
15B of the Jesse Lee Heights Subdivision Addition No.4 (the "Properties") owned by Frank Irick
("Irick") upon which are located the remaining historic structures ofthe former Jesse Lee Home; and
WHEREAS, the City, Irick, and Dan Claugus ("Claugus") entered into an agreement dated
June 11, 1996 and approved by Resolution No. 96-084; and
WHEREAS, the Agreement was entered into as a result of a judgment received by the City
in the Superior Court to foreclose its lien for delinquent installments on the special assessments and
Irick appealed that judgment to the Alaska Supreme Court; and
WHEREAS, the City found such agreement to be in the best interests of the City and its
inhabitants and in furtherance of the public purposes of the City that the historic structures in the
Jesse Lee Home properties be restored; and
WHEREAS, the deadline for completing reconstruction and restorat~(;m ofthe property was
September 30, 1998, but the reconstruction and restoration had not been completed by that date; and
WHEREAS, the parties desire to extend the time permitted to complete the restoration and
reconstruction until September 30, 2000, and in consideration, Irick will comply with the terms of
the conditional use permit issued by the Seward Planning and Zoning Commission dated August 28,
1998, which includes a requirement for constructing a pedestrian and bicycle pathway through the
easement previously granted to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to execute an amendment to the
Agreement among the City, Irick and Claugus substantially in the form attached hereto.

Section 2. The City Manager is hereby authorized to take all actions necessary to carry out
the terms of the Agreement, as amended, authorized under Section 1.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 8th day
of February, 1999.
