RESOLUTION 99-036
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING A CONTRACT BETWEEN THE CITY OF
SEWARD, ALASKA AND THE UNITED STATES DEPARTMENT OF
AGRICULTURE NATURAL RESOURCES CONSERVATION SERVICE
FOR CONTRACT MANAGEMENT OF DESIGN AND ENGINEERING
SERVICES FOR THE NORTH FOREST ACRES LEVEE AND JAPANESE
CREEK LEVEE EXTENSION
WHEREAS, the Resurrection River and Japanese Creek Flood Mitigation Task Force was
created following the 1995 flood event to develop a comprehensive flood mitigation plan for the
Resurrection River and Japanese Creek; and
WHEREAS, the task force report released May 8, 1998 contained the comprehensive flood
mitigation plan; and
WHEREAS, a North Forest Acres levee, between the Seward Highway and Dimond
Boulevard, and the Japanese Creek levee extension are components of the plan; and
WHEREAS, these two projects will create a single levee that insulates the north end oftown
from flooding by the Japanese Creek and Resurrection River; and
WHEREAS, the City lobbied for and received $500,000 through the Natural Resource
Conservation Service to begin the work on these two levees; and
WHEREAS, the funds will be used to contract the design and engineering services for
the two levees, which includes the necessary permitting processes, with any remaining funds
being used for construction ofthe levees; and
WHEREAS, the City of Seward accepts all the responsibilities of contract management and
reporting requirements necessary for the use of federal funds, and in return the Natural Resource
Conservation Service will provide technical assistance and support, and will pass through the
appropriated funds; and
WHEREAS, the City will receive a 5% administrative fee (from the total grant) for the
contracting management work;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:

Section 1. The City Manager is hereby authorized to enter into a contract with the United
States Department of Agriculture, Natural Resources Conservation Service to accept and spend
federal funds to contract for design and engineering services for the construction of a dike along the
Resurrection River and Japanese Creek between the Seward Highway and the end of the existing
Japanese Creek dike as set forth in the agreement between the City of Seward, Alaska and the United
States Department of Agriculture, Natural Resources Conservation Service.
Section 2. Federal grant funds are accepted in the amount of$500,000 to the NRCS Flood
Mitigation Fund account number 666-6660-4680-0100, and appropriating $150,000 for an
Environmental Assessment, $325,000 for Design and Engineering, and $25,000 for administrative
cost reimbursement for contract management, to accounts 666-6660-5XXX.
Section 3. It is in the public interest to accept and expend funds for erosion and flood
control.
Section 4. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 22 day
of March, 1999.
