RESOLUTION NO. 99-047
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING A CORRECTION TO THE LEASE RATE FOR
A PORTION OF LOT 1, BLOCK 4, FOURTH OF JULY CREEK
SUBDIVISION, SEWARD MARINE INDUSTRIAL CENTER, LEASED TO
PAT MARRS DBA COMMUNICATIONS NORTH, TO EIGHT PER CENT
OF THE APPRAISED VALUE OF THE LAND.
WHEREAS, the intent of the City of Seward is to encourage development and stimulate
business in a fair, consistent manner; and
WHEREAS, Pat Marrs, dba Communications North, recently expanded his lease
property at SMIC in order to construct a building for his business; and
WHEREAS, while conducting a normal review of the lease file during this process, an
irregularity in the lease rate was discovered; and
WHEREAS, the original lease rate is in contrast to the standard of eight per cent of the
appraised value of the land as established in the MacSwain Associates Appraisal Report of May
5, 1995; and
WHEREAS, in order to make this lease consistent with other leases and practices, the
annual lease rate should be changed to eight per cent of the appraised value;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to amend the lease rate for lease number RE-
97 -101, the rate to reflect eight per cent of the appraised value based on the MacSwain
Associates Appraisal Report of May 5, 1995.
Section 2. All other provisions of the lease remain unchanged and all future lease rates
will be based on the most current appraisal report provided by an agency or person at the request
of the City.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
26th day of April, 1999.
