Commission Introduction Date: April 28 1997 Public Hearing Date: Mav 12 1997 CITY OF SEWARD, ALASKA ORDINANCE NO. 97-12 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING THE SEWARD ZONING CODE REGARDING REQUIRED YARD SETBACKS FOR CORNER LOTS WITH MULTIPLE FRONTAGES WHEREAS, the Seward Zoning Code defines set back as the required distance from right-of- way or lot line that establishes the area within which only fencing, landscaping, driveways, parking and similar uses are permitted; and WHEREAS, structures are specifically prohibited in the setbacks; and WHEREAS, Seward City Code Table 15.10.220 identifies the required yard setbacks for all zoning districts within the City; and WHEREAS, in order to provide consistency for all property owners, certain housekeeping amendments to setback requirements for corner lots with multiple street frontages are in order; and WHEREAS, at its April 2, 1997 meeting, the Planning and Zoning Commission reviewed and recommended City Council approval of the amendments contained in this ordinance; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. Seward City Code Section 15.10.140 B. is hereby amended by adding the following sentence to the definition of "Yard, rear": "In cases of double frontages and corner lots, there are no rear yards, only front and side yards. " Section 2. Seward City Code Section 15.10.220 is hereby amended to read as follows: 15.10.220 Development requirements. A. Table 15.10.220, Development requirements, is incorporated herein by reference and the restrictions contained therein are mandatory unless otherwise modified by this chapter. (See Tables at the end of this Title; see also SI5.10.210.) B. Buildin'i height. The purpose of building height standards is to prevent loss of lift or excessive property damage through the inability of the city fire department to reach upper stories or roofs and to help maintain the character of neighborhoods. C. Setbacks - vards. 1. Setbacks are required to insure sufficient open area for snow accumulation, sunlight, views, privacy, fire separation and visual relief between structures. No yard or other open space provided about any building for the purpose of complying with the provisions of this chapter shall be considered as providing a yard or open space for any other building, and no yard or open space on one lot shall be considered as providing a yard or open space on any other lot. 3. No yard or lot shall be reduced in size or area below the minimum requirements set forth herein. Yards or lots created after December 5, 1978 shall meet at least the minimum requirements established by this chapter. 4. In cases of corner lots with multiple frontages, the administrative official shall designate the front yard, and all other frontages shall be designated as a side to a street. Section 3. Seward City Code Table 15.10.220, Development Requirements, is amended to require no side yard setback adjacent to a street in the Harbor Commercial Zoning District. Section 4. This ordinance shall take effect ten (10) days following its enactment. ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 12th day of May, 1997.
