CITY OF SEWARD, ALASKA
ORDINANCE NO. 97-13
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING THE SEWARD ZONING CODE TO ALLOW A
SHOOTING RANGE IN THE INSTITUTIONAL ZONING DISTRICT BY
CONDITIONAL USE PERMIT
WHEREAS, the American Legion intends to lease Kenai Peninsula Borough land near the
old Seward landfill site for a shooting range; and
WHEREAS, the borough land is currently zoned Institutional and the Seward Zoning Code
does not allow a shooting range in the Institutional Zoning District; and
WHEREAS, the Zoning Code currently allows a recreational shooting range in the Resource
Management Zoning District by Conditional Use Permit; and
WHEREAS, the Institutional District appears to be an appropriate zone to allow a
recreational shooting range; and
WHEREAS, requiring a Conditional Use Permit prior to the development and operation of
a shooting range in the Institutional District will allow for controls and safeguards to assure that the
use is compatible with the surrounding area; and
WHEREAS, at its April 2, 1997 meeting, the Planning and Zoning Commission conducted
a public hearing and voted to recommend Council approval of this proposed Zoning Code
amendment;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA
HEREBY ORDAINS that:
Section 1. Seward City Code Table 15.10.225 is hereby amended to allow a "Recreation,
shooting range" in the Institutional District by Conditional Use Permit.
Section 2. This ordinance shall take effect ten (10) days following its enactment.
ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this
12 day of May, 1997.
