RESOLUTION 99-110
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, DETERMINING IT TO BE IN THE PUBLIC INTEREST TO
PROCEED WITH THE SPECIAL IMPROVEMENT DISTRICT CALLED
THE FOREST ACRES AND AUTHORIZING AN AMOUNT NOT TO
EXCEED $122,993 TO BE FUNDED FROM THE GENERAL FUND, THE
W ATER/SEWERENTERPRISE FUND AND THE ELECTRIC ENTERPRISE
FUND
WHEREAS, a public hearing was held on July 12, 1999 concerning the establishment ofthe
Forest Acres Improvement District for the purpose of installing roads, sewer and electrical service
to 7 properties within the Forest Acres Subdivision and the City Council on July 26, 1999 approved
Resolution No. 99-082 determining to proceed with the Special Improvement District called the
Forest Acres Improvement District; and
WHEREAS, Resolution No. 99-082 authorized proceeding with the improvement district,
but did not authorize the funding necessary to complete the project; and
WHEREAS, engineering estimated the cost of the project at $122,993 or approximately
$17,570 per lot to build the road, install sewer and electrical service to the improvement district; and
WHEREAS, the cost of building the road is estimated at $13,225 and will be funded from
the General Fund fund balance; the cost of the sewer installation is estimated at $85,963 and will be
funded from Water/Sewer Enterprise Fund; and the cost of installing the electrical system is
estimated at $23,805 and will be funded from the Electrical Enterprise Fund; and
WHEREAS, after a full review by the City Council of all the facts and opinions presented,
it is hereby found and determined that the proposed special improvement district is necessary and
will benefit the property assessed;.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The special improvement district called the Forest Acres Improvement District
to cover an area described as follows:
Lots BO, BR, BS, BW, BX, BY and BZ Forest Acres Subdivision
shall proceed.

Section 2. That the City Manager is hereby authorized and directed to proceed with the
design and construction of the proposed improvement.
Section 3. That the City Manager is hereby authorized and directed to keep account of all
of the costs of the improvement including acquisition of interests in land for the improvement
including design, engineering, administration, overhead, professional services, guarantee fund, bond
or loan costs and interest incurred as a result of the improvement, and all other costs resulting from
the construction of the improvement.
Section 4. That funds in the amount of$122,993are hereby authorized to finance the Forest
Acres Improvement District of which $13,225 is appropriated from the General Fund fund balance,
account no. 101-0000-3050 to the Roads & Street Contracted Services, account no. 101-1310-5390,
$85,963 is authorized from the Water/Sewer Enterprise Fund and $23,805 is authorized from the
Electric Enterprise Fund.
Section 5. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council ofthe city of Seward, Alaska, this 9 day
of August, 1999.
