CITY OF SEWARD, ALASKA
RESOLUTION NO. 92-007
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING AN ARBITRATION WITHDRAWAL
AGREEMENT REGARDING THE SEWARD SHIP'S CHANDLERY ARBITRATION
WHEREAS, Seward Ship's Chandlery and the city of Seward are
engaged in the process of arbitrating certain differences and
disputes concerning the obligations of the parties under the terms
of a lease agreement and tariff; and
WHEREAS, Seward Ship's Chandlery has approached the city of
Seward with a request to negotiate a new lease for the lease of
lands at the Seward Marine Industrial Center; and
WHEREAS, the city council arranged and held a special work
session on December 30, 1991, for the purpose of discussing the
request; and
WHEREAS, the consensus of the councilmembers expressed at that
meeting was to continue potential negotiations with Seward Ship'S
Chandlery; and
WHEREAS, if successful the negotiations may obviate the need
for continuation of the arbitration process; and
WHEREAS, attorneys for the city and Seward Ship'S Chandlery
have met and proposed a schedule for those negotiations and a
process whereby the arbitration may be held in abeyance pending
those negotiations; and
WHEREAS, it is in the public interest to attempt negotiations
of a new arrangement;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The city administration is directed to commence
negotiations with Seward Ship's Chandlery in general accordance
with the proposed schedule attached hereto as Exhibit A.
Section 2. The city attorney is directed to inform the
American Arbitration Association, with attorneys for Seward Ship's
Chandlery, that the pending arbitration is to be suspended in
accordance with the terms of that arrangement attached hereto as
Exhibit A.

Section 3. This resolution shall take effect immediately upon
its adoption.
PASSED AND APPROVED by the City Council of the city of Seward,
Alaska, this 13th day of January, 1992.
