RESOLUTION 2001-026
A RESOLUTION OFTHE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA,
AUTHORIZING THE CITY MANAGER TO ENTER INTO A MEMORANDUM OF
UNDERST ANDING WITH THE LOWELL POINT COMMUNITY COUNCIL
(LPCC) ALLOWING, UNDER CERTAIN CONDITIONS, A CONNECTION
BETWEEN THE LPCC W ASTEW ATER SYSTEM AND THE CITY OF SEWARD
W ASTEW ATER TREATMENT PLANT
WHEREAS, the Lowell Point Community Council (LPCC) is seeking funding from the
Alaska Department of Conservation (ADC), Village Safe Water program, to design a wastewater
system for the Lowell Point area; and,
WHEREAS, LPCC has requested permission to connect their wastewater system to the City
of Seward Sewage Treatment Plant at Lowell Point; and,
WHEREAS, if the Lowell Point Community was included inside the City of Seward City
Limits the funding from the Village Safe Water program would not be available; and,
WHEREAS, the Memorandum of Understanding includes conditions which protect the City
of Seward from having to spend capital or maintenance funds to accommodate this request and
provides for certain other conditions to protect the City of Seward; and,
WHEREAS, LPCC must obtain the approval ofthe City of Seward for the interconnection
in order to qualify for funding under the Village Safe Water Program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to enter into an agreement (Attachment l) with
the Lowell Point Community Council to allow interconnection, with certain conditions, of the
LPCC wastewater system and the City of Seward Sewage Treatment Plant.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 12th
day of February 2001.
