RESOLUTION 2001-033
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
ENTER INTO A CONTRACT WITH KODIAK LUMBER LIMITED, d/b/a
AFOGNAK LOGGING TO REMOVE BETWEEN 4,000 AND 10,000 TONS
OF RIP-RAP FROM THE 4TH OF JULY ROCK QUARRY FOR THE
ALASKA RAILROAD DOCK PROJECT AT A PRICE OF $1.50/TON.
WHEREAS, Kodiak Lumber Limited, d/b/a Afognak Logging (Afognak) may secure a
contract to construct the Seward Railroad Dock project for the Alaska Railroad Corporation (the
Project); and,
WHEREAS, the Project will require between 4,000 and 10,000 tons of Rip-Rap; and,
WHEREAS, this amount of rock may be available from our 4th of July Creek Rock Quarry;
and,
WHEREAS, Afognak has requested a contract with the city of Seward to work the 4th ofJuly
Rock Quarry to remove between 4,000 and 10,000 tons of Rip-Rap for the Project; and,
WHEREAS, Afognak has proposed a price of $1.50/ton for rock removed from the quarry
which should provide approximately $6,000 to $15,000 in revenue to the City of Seward General
Fund; and,
WHEREAS, Afognak will measure the amount of rock removed froll} the quarry by
weighing the rock on a scale at the quarry site; and,
WHEREAS, this will be a non-exclusive contract at fair market value for a term to be
specified; and,
WHEREAS, pursuant to Resolution 2000-111, Wilder Construction Company has prior non-
exclusive rights to remove Rip-Rap from the quarry, and it would be impossible for another operator
to work in the quarry while Wilder is working; and,
WHEREAS, in accordance with Section 6.10.310 ofthe City Code the City Council may
determine that competitive bids are not in the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to negotiate and enter into a contract with Afognak for

the removal of up to 10,000 tons of Rip-Rap at a price of$1.50/ton as measured on a portable scale
at the quarry. The form ofthe contract will be in substantially the form as presented at this meeting.
Section 2. The City Council finds that competitive bids or proposals are not necessary or in the
public interest under these circumstances due to, among other facts, that this will be a non-exclusive
contract for the City to sell rock to Afognak, and the price is at least fair market value.
Section 3. The effectiveness ofthis resolution is conditioned upon Afognak securing a contract with
for providing Rip-Rap to the Project, within two months from the date hereof, and conditioned
further upon the availability of access to the quarry in a manner that will not interfere with Wilder's
existing rights to the quarry.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska, this 26th
day of February, 2001.
