CITY OF SEWARD, ALASKA
RESOLUTION NO. 99-142
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO EXECUTE AMEND-
MENT NO.3 OF THE CONTRACT WITH USA WASTE OF ALASKA, INC.
EXTENDING THE TERM OF THE CONTRACT FOR ONE ADDITIONAL
YEAR
WHEREAS, the City of Seward entered into a contract for the collection and disposal of
garbage, rubbish and waste material with Jason McDonald, dba Jason Enterprises on October 12,
1992; and
WHEREAS, this contract followed approval by the voters of Seward of a franchise
agreement for the collection and disposal of garbage and refuse. The contract was for five years
beginning January 1, 1993 with options to extend, upon satisfactory performance, for up to three
additional one year terms; and
WHEREAS, the first one year extension was approved August 11, 1997 which extended the
contract to December 31, 1998; and
WHEREAS, the City Council approved an assignment on June 27, 1998 to USA Waste of
Alaska; and
WHEREAS, the second of the one year extensions was approved September 28, 1998
extending the contract until December 31, 1999; and
WHEREAS, the administration offered USA Waste of Alaska, Inc. the opportunity to extend
the contract, conditioned on City Council approval, as their performance has been more than
satisfactory; and
WHEREAS, USA Waste of Alaska, Inc. has executed the attached copy of Amendment No.
3 indicating that they look forward to continuing their relationship with the City of Seward.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. Amendment No.3 to the contract with USA Waste of Alaska, Inc. for the
collection and disposal of garbage, rubbish and waste material in the City of Seward, Alaska is
hereby approved extending the contract for one additional year until December 31, 2000.

RESOLUTION NO. 99-142
Section 2. The City Manager is authorized to execute Amendment No.3 between the City
of Seward and USA Waste of Alaska, Inc.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 11 th
day of October, 1999.
