CITY OF SEWARD, ALASKA
RESOLUTION NO. 79-40
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, REMOVING RESTRICTIONS ON USES OF LAND
CONTAINED IN LEASES OF LOTS WITHIN THE MARINA
SUBDIVISION.
WHEREAS, the City of Seward is the owner of all of the
lots located in the Marina Subdivision, and
WHEREAS, the City of Seward has previously disposed of
all of the lots in the Marina Subdivision by long-term leases,
and
WHEREAS, each of the leases of lots within the Marina
Subdivision contains specific, exclusive uses to which each
particular lot may be dedicated, and
WHEREAS, the City Council hereby determines that it is
in the public interest to relieve each lot covered by such
leases from the burden of being used only for the uses set
forth in each particular lease, and
WHEREAS, the City Council hereby finds that regular
business decisions concerning use of each lot will put each lot
to the highest commercial use possible without further
supervision by the City Council:
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Seward that
Section l. The City Council hereby exercises its
right to approve additional uses of the properties within the
Marina Subdivision by specifically approving in advance each
and every use which is permitted by the zoning regulations
covering the particular lot of each respective lease.
Section 2. The blanket approval of all uses allowed
by the zoning ordinance granted in Section 1 in no way alters
the necessity of a tenant's seeking the approval of the City
Council for other purposes contained in the lease including,
but not limited to, construction requirements imposed upon
various lots and the assignment or sublease of any or all lots.
No consent is given in Section 1 for any use requiring new construction
or alteration of an existing structure which necessitates issuance
of a building permit.
