RESOLUTION NO. 79-43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, PROVIDING FOR THE DISPOSAL OF LOT 13, MARATHON ADDITION AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE THE SALE THEREOF. WHEREAS, the City of Seward is the owner of Lot 13, Marathon Addition located within the city limits of the City of Seward~ and WHEREAS, the lot is suited for use by and desired by the Seward Volunteer Ambulance Corps, a charitable non-profit corporation,organized and existing under the laws of the State of Alaska~ and WHEREAS, the City Council hereby determines that it is in the public interest for the lot to be used for the construction of an ambulance garage and training center for the Seward Volunteer Ambulance Corps; and WHEREAS, the City Council hereby finds that the lot has not previously been dedicated to any public use, and WHEREAS, the City Council hereby finds that it is not in the public interest to offer such lot for public sale and that the negotiation of the sale of such lot is in the public interest: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Seward, Alaska that Section 1. The City Council of the City of Seward hereby authorizes and directs the City Manager to negotiate the sale of Lot 13, Marathon Addition to the Seward Ambulance Corps for the sum of Ten Dollars ($10.00), provided, however, that the City reserve to itself a right of first refusal which will permit the City to repurchase the lot plus its improvements for a total cost equal to the original purchase price set forth herein. Section 2. The deed conveying the lot to the Seward Volunteer Ambulance Corps shall contain a reversionary clause which will compel the Seward Voluteer Ambulance Corps to offer the lot to the City at such time as the Seward Volunteer Ambulance Corps ceases to use the lot for an ambulance garage and training center or if the Seward Volunteer Ambulance Corps should fail to construct an ambulance garage and training r center on the lot within four years from the date of the conveyance to the Seward Volunteer Ambulance Corps. 1979.
