HomeMy WebLinkAboutRes1979-047 r= 11/j/79 klr THE CITY OF SEWARD, ALASKA RESOLUTION NO. 79-47 A RESOLUTION APPROVING THE TRANSFER OF LAND IN THE FOURTH OF JULY CREEK AREA WHEREAS, the City of Seward is planning the construction of an Industrial Park in the Fourth of July Creek area known as the "Industrial Park"; and WHEREAS, the plans for the Industrial Park include use of lands owned by private parties as well as some lands soon to be owned by the City of Seward; and WHEREAS, the privately owned lands needed for the Industrial Park are hereafter referred to as "Tract One" as outlined in red on Exhibit "A" which is attached hereto and is incorporated herein by reference; and WHEREAS, the City will soon be owner of other lands contiguous to Tract One, which lands are hereafter referred to as "Tract Two" and are more particularly described as follows: All of the City's interest in U.S. Survey 4827, situated in TIS, RIE, and RIW, S.M., located in the State of Alaska. WHEREAS, the City Council hereby finds that Tract Two has not previously been dedicated to a public use; and WHEREAS, the City Council hereby further finds that it is in the public interest to dispose of Tract Two in exchange for Tract One and that it is not in the best public interest to dispose of Tract Two by public sale and that it is in the public interest to acquire Tract One for Tract Two by negotiation or condemnation: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Manager is hereby authorized and directed to negotiate the disposal of Tract Two as described above by the exchange of that parcel for Tract One as described above. No consideration for Tract One shall be given by the City except for simple ownership of Tract Two. Section 2. In the event of failure by the City Manager to negotiate the lands exchange described in Section 1, the City Manager is hereby author- ized to collect such information and prepare such plans as are necessary to serve as a basis for condemnation of Tract One. r City of Seward, Alaska Resolution No. 79-47 Page Two PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 5th day of November 1979.
