CITY OF SEWARD, ALASKA
RESOLUTION NO. 79-48
A RESOLUTION ADJUSTING THE PAYMENT IN LIEU OF TAXES
CHARGED TO THE ELECTRIC UTILITY FOR THE
FISCAL YEAR ENDING JUNE 30, 1979
WHEREAS, the City Council annually determines an amount to be paid
by the Electric Utility as a payment in lieu of real property taxes; and
WHEREAS, the City Council has established a policy of fixing the
amount of the payment in lieu of taxes at a level necessary to cover an
established percentage of the cost of other City functions directly or
indirectly connected to the Electric Utility; and
WHEREAS, the City Council has determined that the amount of the
payment in lieu of taxes made by the Electric Utility exceeded the cost of
related City functions by $25,000; and
WHEREAS, the City Council hereby finds that the excess payment
in lieu of taxes should be refunded to the Electric Utility as an amount
previously erroneously charged to the Utility;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, tha t:
Section 1. There is hereby refunded to the City Electric
Utility the amount of $25,000 which constitutes the excess of
the Utility's payment in lieu of taxes over the amount intended
to be assessed against the Utility by the City Council as a fair
charge for certain related City functions. This adjustment
corrects the error set forth in the original budget related to
the cost of such City functions.
Section 2. The adjustment is considered effective for the
fiscal year ending June 30, 1979, and all records of both the
City of Seward and the Electric Utility shall be amended to
reflect accurately such correction.

ALASKA, this 5th day of November, 1979.
