RESOLUTION NO. 94-052
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, ACCEPTING ALASKA STATE TIDELANDS
PATENT NO. 362 CONVEYING ALASKA TIDELANDS SURVEY
1222 TO THE CITY OF SEWARD
WHEREAS, in March 1981, the city of Seward (CITY) applied to Alaska Department
of Natural Resources (DNR) for the lease of state tidelands associated with the Seward Marine
Industrial Center (SMIC) development at Fourth of July Creek; and
WHEREAS, in December 1983, CITY transmitted a completed survey plat for Alaska
Tidelands Survey (ATS) 1222 to DNR; and
WHEREAS, in July 1986, CITY requested DNR to change the ATS 1222 lease request
to a fee simple title conveyance pursuant to AS 38.05.320(b); and
WHEREAS, CITY has adopted a tideland preference ordinance compatible with state
regulations; and
WHEREAS, CITY has completed a preliminary subdivision of lands in the Fourth of
July Creek area to provide for state land and water access in return for the vacation of shoreline
pedestrian easements that conflict with the industrial nature of SMIC; and
WHEREAS, the State of Alaska has prepared and submitted Tidelands Patent No. 362
conveying ATS 1222 tidelands to CITY;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEWARD, ALASKA, that:
Section 1. The City of Seward hereby accepts State Tidelands Patent No. 362 conveying
Alaska Tidelands Survey No. 1222 from the State of Alaska to the City of Seward.
Section 2. This resolution shall take effect thirty days following passage and posting as
required by law.
PASSED AND APPROVED by the City Council ofthe city of Seward, Alaska, this 9th
day of May, 1994.
