RESOLUTION NO. 94-095
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, REAFFIRMING RESOLUTION NO. 94-064
WHEREAS, on February 11, 1994, Robert H. Ferguson, III, submitted a proposal
to the city to lease approximately 1800 square feet of city property in the tidelands within
the northeast comer of the Seward Small Boat Harbor; and
WHEREAS, on May 23, 1994, the City Council adopted Resolution No. 94-064,
approving a lease of the property from the city to Mr. Ferguson; and
WHEREAS, subsequent to that action, a question was raised to the administration
and the Council regarding the propriety of leasing city property to a city employee; and
WHEREAS, the City administration and the City Council have reviewed the facts
surrounding the development of a site plan for the boat launch ramp to be constructed
adjacent to the leased property and the subsequent proposal for lease submitted by Mr.
Ferguson; and
WHEREAS, the City Council has concluded that Mr. Ferguson's proposal was
based on information which was available to the general public and was not based on
any knowledge gained solely as a result of Mr. Ferguson's employment with the city of
Seward; and
WHEREAS, the City Council has found that the lease granted under Resolution
No. 94-064 was approved in accordance with the lease provisions of the Seward City
Code and in accordance with standard city lease procedures;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council hereby REAFFIRMS City of Seward Resolution No.
94-064, granting a lease of city property to Mr. Robert H. Ferguson, III.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
11th day of July, 1994.
