RESOLUTION NO. 94-174
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING AMENDMENT NO.4
CONFIRMING COMPLETION OF THE SPRING CREEK
CORRECTIONAL CENTER PROJECT NO. 57863
WHEREAS, on October 17, 1985, the City Council adopted Resolution No. 85-92,
approving a project management services agreement with the Alaska Deparbnent of
Transportation and Public Facilities for the purpose of construction of the Spring Creek
Correctional Centerj and
WHEREAS, construction of the prison under this agreement is now complete and
the state has requested approval of an amendment to the agreement to confirm that the
project is completej
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized and instructed to execute
Amendment No.4 to the Project Management Services Agreement between the City and
the Alaska Deparbnent of Transportation and Public Facilities confirming that the Spring
Creek Correctional Center Project Number 57863 is complete.
Section 2. A copy of the amendment is attached and incorporated herein by
reference.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
12th day of September, 1994.

DEPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES
AMENDMENT NO. 4
TO THE
PROJECT MANAGEMENT SERVICES AGREEMENT
WITH
THE CITY OF SEWARD
The Project Management Services Agreement, effective the 17th day
of October, 1985, between the state of Alaska Department of
Transportation and Public Facilities and the City of Seward for
the purpose of construction of the spring Creek Correctional
Center is hereby amended as follows:
By execution of the Amendment, the State hereby agrees
that it has been paid in full by the municipality in
the amount o( Four Hundred Fifty-five Thousand One
Hundred Sixty-three and 73/100 dollars ($455,163.73),
and that this figure represents the final funding level
for this project and Agreement.
The State further agrees and certifies that the project
scope, as originally written or as may have been
subsequently amended by written mutual agreement of
both parties, has been completed in full by the terms
of said Agreement. and/or Amendment.
The Municipality hereby agrees that it accepts the
project as described in Appendix A to the Agreement, or
as may have been subsequently amended by mutual
agreement of both parties.
In witness thereof, the parties hereto have executed this
Amendment No. 4 to the Agreement as of the /2~ day of
