Sponsored by: Jones CITY OF SEWARD, ALASKA RESOLUTION NO. 94-205 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, TERMINATING THE NASH ROAD SMALL BOAT HARBOR DEVELOPMENT AGREEMENT WHEREAS, on February 14, 1994, the City Council approved a development agreement for the Nash Road Small Boat Harbor which authorized Al Schafer and Afognak Logging to pursue development of a boat harbor; and WHEREAS, one requirement of the development agreement was that Schafer obtain written consent to the development from adjacent property holders; and WHEREAS, such written agreements have not been submitted and both Schafer and the impacted adjacent property holder have indicated a reluctance to pursue further resolution of this matter; and WHEREAS, failure to obtain such agreements terminates the original development agreement; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The Nash Road Small Boat Harbor Development Agreement between the City of Seward and Al Schafer is hereby TERMINATED. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 28th day of November, 1994.
