RESOLUTION NO. 94-208
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING A SETTLEMENT AGREEMENT
BETWEEN THE CITY OF SEWARD AND J.W.T. ANDERSON
WHEREAS, J.W.T. Anderson has filed suit against the City of Seward for alleged
damages to his boat, the BIG FLO; and
WHEREAS, the City's records of the actions taken with regards to the alleged
impoundment of the BIG FLO are insufficient to assure a successful defense at trial; and
WHEREAS, it is in the best interest of the City to settle this claim as expeditiously as
possible; and
WHEREAS, the plaintiff has offered to settle for payment in the amount of $125,000;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to execute a settlement agreement with
J.W.T. Anderson et al in the amount of $125,000 plus additional non-cash considerations.
Section 2. The amount of $125,000 is hereby appropriated from the Harbor Enterprise
Fund Reserve Account No. 401-0000-3050 to the Small Boat Harbor State Facilities Miscella-
neous Expenses Account No. 401-4001-5790.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council ofthe city of Seward, Alaska, this 28th
day of November, 1994.
