Sponsored by: Klinkner & Murphy CITY OF SEWARD, ALASKA RESOLUTION NO. 94-122 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, PROVIDING FOR THE SUBMISSION TO THE QUALIFIED VOTERS OF THE CITY OF SEWARD THE QUESTION OF AMENDING SECTIONS 5.3(b), 5.4(c), 5.4(f) AND 5.5(g), AND ENACTING SECTION 5.5(h) OF THE CHARTER OF THE CITY OF SEWARD AT AN ELECTION IN AND FOR THE CITY OF SEWARD ON OCTOBER 4, 1994 WHEREAS, Section 14.2 of the Charter of the City of Seward provides that the Charter may be amended by proceedings commenced by the vote of four members of the council; and WHEREAS, Section 14.3 of the Charter of the City of Seward provides that when an amendment to the Charter is proposed by the council, it shall be submitted to the qualified voters of the City at any election to be held in the City not less than 60 days after its proposal by the council; and WHEREAS, it is in the best interest of the City and its residents that Section 5.3(b), 5.4(c), 5.4(f) and 5.5(g) of the Charter of the City of Seward be amended and Section 5.5(h) of the Charter of the City of Seward be enacted as set forth below. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The council hereby proposes that Sections 5.3(b), 5.4(c), 5.4(f) and 5.5(g) of the Charter of the City of Seward, relating to the city clerk, be amended, and Section 5.5(h) of the Charter of the City of Seward, relating to the city clerk, be enacted, to read as follows: Section 5.3(b): (b) All other administrative officers, except members of city boards and employees in the city clerk deparbnent, shall be appointed by the city manager. Section 5.4(c): (c) He shall supervise and coordinate the work of the administrative officers and deparbnents of the city, except the city attomey, the city clerk and the city clerk deparbnent, and . . . CITY OF SEWARD, ALASKA RESOLUTION NO. 94-122 he shall act as coordinator between these officers and the other administrative officers. Section 5.4(f): (f) He shall employ or be responsible for the employ- ment of all city employees except employees in the city clerk deparbnent, and supervise and coordinate the personnel poli- cies and practices of the city. Section 5.5(g): (g) He shall perform such other duties in connection with his office as may be required of him by law or by the council. Section 5.5(h): (h) The council may provide in the Code for a city clerk deparbnent. The city clerk shall be responsible for the employment of all city employees in the city clerk depart- ment. Section 2. An election is to be held on October 4, 1994, in and for the City of Seward, for the purpose of submitting to the qualified voters of the City of Seward a proposition substantially in the following form: PROPOSITION NO. AMENDMENT OF SEWARD CITY CHARTER SECTIONS 5.3(b), 5.4(c), 5.4(f) AND 5.5(g), AND ENACTMENT OF SEWARD CITY CHARTER SECTION 5.5(h) Shall Sections 5.3(b), 5.4(c), 5.4(f) and 5.5(g) of the Charter of the City of Seward, relating to the city clerk, be amended, and Section 5.5(h) of the Charter of the City of Seward, relating to the city clerk, be enacted, to read as follows: Section 5.3(b): (b) All other administrative officers, except members of city boards and employees in the city clerk department, shall be appoint- ed by the city manager. . . . Section 3. The amendment proposed by this resolution shall be published not less than two weeks nor more than four weeks before the October 4, 1994 election, at the same time and in the same manner as the notice of that election. Section 4. This resolution shall take effect immediately upon its adoption. The amendment set forth in Section 1 shall become effective upon its approval by a majority of the qualified voters voting on the question at the election of October 4,1994, and the filing of the amendment as provided in Section 14.7 of the Charter of the City of Seward.
