Sponsored by: Klinkner & Murphy CITY OF SEWARD, ALASKA RESOLUTION NO. 94-129 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, PROVIDING FOR THE SUBMISSION TO THE QUALIFIED VOTERS OF THE CITY OF SEWARD THE QUESTION OF AMENDING SECTION 11.1(a)(2) AND REPEALING SECTION 15.1 OF THE CHARTER OF THE CITY OF SEWARD AT AN ELECTION IN AND FOR THE CITY OF SEWARD ON OCTOBER 4, 1994 WHEREAS, Section 14.2 of the Charter of the City of Seward provides that the Charter may be amended by proceedings commenced by the vote of four members of the council; and WHEREAS, Section 14.3 of the Charter of the City of Seward provides that when an amendment to the Charter is proposed by the council, it shall be submitted to the qualified voters of the City at any election to be held in the City not less than 60 days after its proposal by the council; and WHEREAS, it is in the best interest of the City and its residents that Section 1l.I(a)(2) of the Charter of the City of Seward be amended and Section 15.1 of the Charter of the City of Seward be repealed as set forth below. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The council hereby proposes that Section 15.1 of the Charter of the City of Seward, relating to revenue bonds, be repealed, and Section 11.1(a)(2) of the Charter of the City of Seward, relating to revenue bonds, be amended to read as follows: (2) Revenue bonds to finance any project that serves a public purpose, which bonds are secured only by revenues of the project or a public enterprise or public corporation of the city, and which do not constitute a debt or a pledge of the faith and credit or taxing power of the city. Such revenue bonds may be authorized by the council and do not require ratification by the qualified electors of the city. Section 2. An election is to be held on October 4, 1994, in and for the City of Seward, for the purpose of submitting to the qualified voters of the City of Seward a proposition substantially in the following form: PROPOSITION NO. . . . CITY OF SEWARD, ALASKA RESOLUTION NO. 94-129 AMENDMENT OF SEWARD CITY CHARTER SECTION 1l.1(a)(2) AND REPEAL OF SEWARD CITY CHARTER SECTION 15.1 Shall Section 15.1 of the Charter of the City of Seward, relating to revenue bonds, be repealed, and Section 11.1(a)(2) of the Charter of the City of Seward, relating to revenue bonds, be amended to read as follows: (2) Revenue bonds to finance any project that serves a public purpose, which bonds are secured only by revenues of the project or a public enterprise or public corporation of the city, and which do not constitute a debt or a pledge of the faith and credit or taxing power of the city. The amendment proposed by this resolution shall be published not less than two weeks nor more than four weeks before the October 4, 1994 election, at the same time and in the same manner as the notice of that election. Section 4. This resolution shall take effect immediately upon its adoption. The amendment set forth in Section 1 shall become effective upon its approval by a majority of the qualified voters voting on the question at the election of October 4, 1994, and the filing of the amendment as provided in Section 14.7 of the Charter of the City of Seward.
