HomeMy WebLinkAboutRes1996-012 , , , Sponsored by: Garzini CITY OF SEWARD, ALASKA RESOLUTION NO. 96-012 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROVING A MEMORANDUM OF AGREEMENT BETWEEN THE CITY AND THE DEPARTMENT OF THE ARMY CORPS OF ENGINEERS TO ALLOW REMOVAL OF SILTATION FROM STORM DAMAGE IN THE SMALL BOAT HARBOR WHEREAS, following the September 1995 flooding, the Corps of Engineers and the Federal Emergency Management Agency (FEMA) assessed quantities and approved funding not to exceed $134,643.75 to remove siltation from the City's portion of the boat harbor; and WHEREAS, the original Corps of Engineers contract with Nehalem River Dredging, Inc., included Alternative A-II providing for the removal of 7,829 cubic yards of material from the city- owned portion of the harbor basin; and WHEREAS, Alternative A-II of the contract has expired and, in order to proceed with the dredging project, the Nehalem contract must be amended by the Corps of Engineers; and WHEREAS, in order to award an amendment authorizing Alternative A-II, the Corps must have in hand a Memorandum of Agreement approved by the City authorizing dredging in the city- owned portion of the basin; and WHEREAS, under the Agreement, the quantity of material dredged must be tied directly to available funds, and the City will have no obligation to bear the cost of any material removed in excess of the $134,643.75 approved by FEMA; and WHEREAS, the Agreement further requires the City to fund up to $39,643.75 of the project before a contract can be awarded and a notice to proceed can be issued by the Corps of Engineers; and WHEREAS, any funds expended by the City to initiate or continue this project will be reimbursed by the Alaska Division of Emergency Services; and WHEREAS, any excess dredge material stockpiled on Lot 4, Block 2, Marina Subdivision, estimated to be approximately 7,829 cubic yards, will become the property of the City; and WHEREAS, it is in the public interest to proceed with this dredging project as soon as possible; CITY OF SEWARD, ALASKA RESOLUTION NO. 96-012 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The City Council approves and the City Manager is hereby authorized to execute a Memorandum of Agreement with the Army Corps of Engineers to allow the removal of siltation from storm damage in the boat harbor. Section 2. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 22nd day ofJanuary, 1996.
