CITY OF SEWARD, ALASKA
RESOLUTION NO. 96-014
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER
TO EXECUTE A NO COST EASEMENT AGREEMENT ALLOWING
THE ALASKA DEPARTMENT OF FISH AND GAME TO UTILIZE
A PORTION OF ALASKA TIDELAND SURVEY 174 FOR DEVELOPMENT
OF MARlCUL TURE FACILITY WATER INTAKE AND DISCHARGE PIPELINES
WHEREAS, the Alaska Department ofFish and Game (ADF&G) has entered into a sublease
agreement with the University of Alaska (the "University") for a portion of Tract 1, Waterfront
Tracts, for the development of a Mariculture Technical CenterIMariculture Production Facility
(MTC/MPF); and
WHEREAS, the City leases all of Tract I, Waterfront Tracts, to the University and consented
to said sublease agreement on September 15, 1995; and
WHEREAS, ADF&G intends to construct, lay, operate and maintain seawater intake and
discharge pipelines for the facility; and
WHEREAS, the City, as owner of the submerged tidelands known as Alaska Tideland
Survey 174 (ATS 174), has authority to grant easements on, under and over City's real property; and
WHEREAS, following a duly advertised public hearing, the City is willing to grant to
ADF&G such an easement under the terms hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The easement agreement, attached and incorporated herein by reference, to allow
the Alaska Department ofFish and Game to use a portion of city-owned tidelands for development
of water intake and discharge pipelines associated with a Mariculture Technical CenterIMariculture
Production Facility, is hereby approved.
Section 2. The easement agreement referenced in Section 1, above, is subject to suspension
within 30 days after passage and posting of this resolution if a sufficient referendary petition is filed
in accordance with Section 4.8 ofthe City Charter.
Section 3. It is in the public interest to dispose of an interest in the designated city lands at
no cost for the purposes outlined in the attached and incorporated easement agreement and to waive
the appraisal requirements set forth in the City Code.

Section 4. This resolution shall take effect 30 days after passage and posting as required by
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 12th day
of February, 1996.
