RESOLUTION NO. 96-035
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING A ONE-YEAR LEASE WITH
DONNA MAREK AND TERRY F. LEE, DBA ALASKAN NIBBLES
AND CHIPS, FOR A PARCEL OF LAND WITHIN
BLOCK 6, OCEANVIEW SUBDIVISION
WHEREAS, Donna Marek and Terry F. Lee have indicated a desire to lease an unplatted
tract ofland located within Block 6, Oceanview Subdivision, for operation of their business Alaskan
Nibbles and Chips; and
WHEREAS, the City Council has determined that a lease of the subject property for the
purposes proposed by Marek and Lee would be in the public interest; and
WHEREAS, a duly noticed public hearing on the proposed lease was conducted before the
Council on March 18, 1996, as required by law; and
WHEREAS, the lease rate for the subject property has been set at fair market value as
determined by recent appraisals in the Small Boat Harbor area;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. A one-year lease of a portion of Block 6, Oceanview Subdivision, measuring
11,635 square feet, mor or less, and including a building covering approximately 988 square feet,
between Donna A. Marek and Terry F. Lee, dba Alaskan Nibbles and Chips, and the City of Seward,
is hereby approved.
Section 2. Essential Terms and Conditions: The lease shall become effective upon the
effective date of the Resolution and shall run through March 31, 1997, and the rental rate for the
leased property shall be assessed at $0.60 per square foot for the full term of the lease. Any suhlease
of the Leased Land, or any portion thereof, must receive the prior written consent of the City
Council.
Section 3. This resolution shall take effect thirty days following passage and posting as
required by law.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 18th
day of March, 1996.
