RESOLUTION NO. 96-054
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AUTHORIZING A CONTRACT WITH
SERVICE ELECTRIC IN AN AMOUNT NOT TO EXCEED $194,146
FOR THE SMALL BOAT HARBOR ELECTRICAL UPGRADE PROJECT
WHEREAS, the City properly advertised a request for proposals to replace three main
distribution panels and install new electrical hook-ups on selected floats in the Small Boat Harbor;
and
WHEREAS, of the seven proposals received, the proposal submitted by Service Electric was
found to be the most responsive and the lowest proposal for the base project after taking into
consideration the local bidder preference, and the proposer was found to be responsible and qualified
to do the work; and
WHEREAS, Raymond Royce, an attorney for the second low proposer Air Tek, Inc., filed
with the City Clerk a request for a stay of award of the contract until an administrative review of the
bid process could be resolved; and
WHEREAS, Mr. Royce and his client were given an opportunity to present their formal
protest to the City Council prior to Council action on this resolution; and
WHEREAS, the City Attorney has provided the Council with a written opinion that the
proposal submitted by Service Electric was responsive to the City's request for proposals and that
Service Electric is a responsible proposer; and
WHEREAS, it is the opinion of the City Council that Service Electric is a responsible and
responsive proposer and that it is in the public interest to award the contract to Service Electric; and
WHEREAS, funding for this project is available in the Harbor Capital Projects Fund Account
No. 302-3020-5390;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized and directed to execute a contract with Service
Electric in an amount not to exceed $194,146 to complete the Small Boat Harbor Electrical Upgrade
as set forth in the City's request for proposals.
Section 2. This resolution shall take effect immediately upon its adoption.
