Sponsored by: Tones CITY OF SEWARD, ALASKA RESOLUTION NO. 92-024 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, REFERRING ORDINANCE 658 TO THE VOTERS AT A SPECIAL ELECTION TO BE HELD IN THE CITY OF SEWARD, ALASKA, ON MARCH 17,1992. WHEREAS, at its regular meeting of January 27, 1992, the City Council of the City of Seward, Alaska, enacted Ordinance No. 658 which provided for creating a hospital department and which amended portions of SCC Chaper 2.30 dealing with the Community Hospital Board; and WHEREAS, on January 28, 1992, an Application for a Referendum Petition was filed with the office of the City Clerk; and WHEREAS, on January 29, 1992, the City Clerk found the Application for the Referendum Petition to be in proper order as required by Seward Code Section 4.15.015; and WHEREAS, on January 29,1992, a Referendum Petition was issued to the sponsors of said referendum in accordance with the requirements of Seward Code Section 4.15.020; and WHEREAS, petition sponsors filed signed petitions with the City Clerk on February 3, 1992; and WHEREAS, the City Clerk certified the Petition as sufficient on February 5, 1992, in accordance with Seward Code Section 4.15.030; and and WHEREAS, no regular election is scheduled within 75 days of February 5, 1992; WHEREAS, Seward Code, Section 4.15.050 provides that when a petition seeks a referendum vote and no regular election occurs within seventy-five days of the certification of a sufficient petition, the council shall hold a special election within seventy-five days of submission to the council; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: . . . CITY OF SEWARD, ALASKA RESOLUTION NO. 92-024 Section 1. Pursuant to Seward Code Section 4.15.050 the following question shall be submitted to the qualified voters of the city at a special election to be conducted on March 17, 1992. An affirmative vote of a majority of those qualified electors voting is required to repeal the ordinance. PROPOSITION NO. 1 Shall Ordinance 658 creating a hospital department and amending portions of Seward City Code Chapter 2.30 dealing with the Community Hospital Board be repealed? YES NO Section 2. A person may vote at this election who possesses the qualifications set forth in AS 15.05.010 and who has registered to vote pursuant to Chapter 7 of Title 15 of the Alaska Statutes and is qualified as set forth in Section 4.01.055 of the Seward City Code. The election shall be conducted in compliance with the procedures established in Title 4 of the Seward City Code. Section 3. Publication of this Resolution shall be made by posting a copy hereof on the City Hall bulletin board for a period of four weeks prior to the election. In addition, copies of the ordinance to be referred shall be available at the City Clerk's office for a least 30 days preceding the date of the election. Section 4. This Resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the City Council of the City of Seward, Alaska this 10th day of February, 1992.
