CITY OF SEWARD, ALASKA
RESOLUTION NO. 92-027
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AUTHORIZING THE DISPOSAL
OF THE GRAIN TERMINAL COMPONENTS
WHEREAS, the City of Seward purchased grain terminal components from the
State of Alaska in August, 1989; and
WHEREAS, there appears to be no reasonable local development option for grain
terminal components; and
WHEREAS, in October, 1991, the City of Seward decided to sell the grain terminal
components by sealed bid; and
WHEREAS, in November, 1991, the City prepared and published a request for
bids to dispose of the grain terminal components: and
WHEREAS, there were no responses from bidders on the grain terminal
components; and
WHEREAS, the City has received an unsolicited request for an exclusive option
to purchase the grain terminal components from American Capitol Investments, Inc.
(ACI), of Kirkland, Washington; and
WHEREAS, the terms of the request for option include a non-refundable $20,000
deposit, and a purchase price greater than that expected; and
WHEREAS, the receipt of such funds could assist the City in its operating and
economic development effort.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized and directed to negotiate and sign an
acceptable option agreement with ACI, generally along the terms contained in Altemative
H, as contained in ACI's letter to the City of Seward dated January 23, 1992:
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the City of Seward, Alaska,
this 10th day of February. 1992.
