Sponsored by: SCJaefermeyer /1 / CITY OF SEWARD, ALASKA RESOLUTION NO. 92-045 A RESOLUTION OF THE CITY COUNCIL OF T CITY OF SEWARD, ALASKA, DETERMINING TO PROCE WITH THE SPECIAL IMPROVEMENT DISTRICT CAL D THE DAIRY HILL SEWER ASSESSMENT DIS RICT WHEREAS, a public hearing has been held purs nt to ~ 5.20.025 of the Seward City Code to receive public comment on the proposed s cial improvement district called the Dairy Hill Sewer Assessment District; and WHEREAS, after a full review by the City ouncil of all the facts and opinions presented, it is hereby found and determined t the proposed special improvement district is necessary and will benefit the prope assessed; NOW, THEREFORE, BE IT RESOL OF SEWARD, ALASKA, that: BY THE CITY COUNCIL OF THE CITY Section 1. The special impro ement district called the Dairy Hill Sewer Assessment District to cover an area d ribed as All of ASLS 72-35; that porti of First Avenue bordering Block 1, Bayview Addition; all of Blocks 1 and 2, Bayview Addition; the vacated street situated between Blocks 1 and 2, Clift ddition, all of Blocks 1, 2,3,4,5, 6, 9, and la, Cliff Addition; Lot 4, Block II, liff Addition; Lots 3 and 4, Block 12, Cliff Addition; Tract A, Cliff Addition R lat No.2; Lots 3, 4, 5, 6 and 7, Laubner Addition; and the West Portion of us 241, 50 feet from the creek, shall proceed. Section 2. B IT FURTHER RESOLVED that the City Manager is hereby authorized and dir ted to proceed with design and construction of the proposed improvement subj t to obtaining suitable financing. Section . BE IT FURTHER RESOLVED that the City Manager is hereby authorized an directed to keep account of all of the costs of the improvement including acquisition 0 nterests in land for the improvement; design, engineering, administration, overhead, ofessional services, guarantee fund, bond costs and interest incurred as a result of e improvement; and all other costs resulting from the construction of the improve ent. Section 4.
